    Please remember that the carrier's insurance covers them and you.

    I have seen individuals, after being denied by insurance and even after being found 'at fault' in traffic court, still file a lawsuit against the driver.

    If you paid out of pocket; when the summons arrives you are all alone.

    Scenario one. Owner op from Ohio tangles with an auto who tired to pass on the right despite his signal.

    She is ticketed and loses in traffic court andour insurance laughs at her claim.

    Still not willing to admit fault she files a civil suit [small claims court] dragging him back to her state.

    No claim and no insurance supplied leagal help.

    Scenario 2 Owner op following an SUV in the rain in the RH lane of NJ Turnpike when a pickp entering looses control and spinsout into the SUV and our rig hits the resulting mess.

    Our insurance denied her insurance claim and evidently so did the pickup's.

    She gets a lawyer to file suit against the two individual drivers knowing it will bring the two insuance legal teams to court.

    This is America anyone can sue anyone for almost anything.

    There's always some hungry shyster that will encourage them to file suit. The last suit we had filed against us was a lot like you described and we were found not to be at fault. It still cost us almost ten thousand dollars to defend ourselves when you figure everything. Depositions, the lawyer's time, travel, lodging, lost time...it all adds up even if you win.
