The company we work for pushes safety big time. We got stuck in that snow storm last week in New Mexico. Couldn't move for 27 hours. Now that company says they won't pay for that. Roads were closed. We sat at a truck stop, kept the truck running and checked the pressure in our tank. We haul oxygen and nitrogen. Hazmat. Is this legal for the company not to pay us for this?![]()

JustSonny Thanks this. -
Sitting it out under a load is NOT the same as being layed over. Just like taking a 10 hr break. Are you laid over? Nooooooooooooooo.

I have fond memories of driving for Tri-State Motor Transit in 1968-69. We were paid the first eight hours and the motel bill when chains were required. When the delay pay stopped, we chained up and went on.

The company has no control of acts of nature. Layover is meant to compensate you lack of freight, or to much time under loads (typically the weekends), things the company may have more control over. I would guess that there may be a company or 2 that pays if you get shut down. But if they all did, they would go broke, everytime a snowflake fell, drivers would be shutting down, then expect to get paid.
Now thinking safety, would this help from drivers pushing it when weather is bas, maybe. Heck I went 10 years before I found out we were allowed to shut down for weather. If the states didn't close the roads, we ran em. Might be rolling at 15mph, but we were rolling, chains and all.Baack Thanks this. -
Just going to throw my 2 cents in here. HAHAHAHAHAHA
Get paid for bad weather. LMFAO Thats Funny.

And here is where a union would come in. Yes, union companies pay their drivers for delay time, for any reason. I don't know too many non-union outfits that even appreciate their drivers that much.

This surprises me with a cryogenic tanker company. My company would have paid for that at the layover rate. First 15 hours free then paid 8 at $13.30/ hour. After that its 10 hours free paid 8 until you get moving again. We even get paid hourly for traffic delays. Come up an a backup, note the time and its on the clock until you start moving again. Same deal with shop repairs. I am on the clock right now waiting for a mechanic to show up and fix something I found on my pretrip. We are not union.

I think a lot more union drivers have lost money walking picket lines than nonunion drivers have lost sitting out storms .tinytim, jamesd503 and hotrod1018 Thank this.

Big 10-4 on that Rick. They lose more money on union dues the we do on lose time do to weather.
