Splitting hairs are we ? For all it's a std. business practice to only confirm employment and dates with a caveat of "is he rehire able" without comment. HOWEVER one would be foolish to even remotely think two HR guys in the same industry don't even casually know each other AND use styles of conversation to get points across. This is to avoid a costly law suit. It's a safe bet there are laws but I'm not a lawyer. There is coverage regarding pregnancy, handicaps and minority applicants.

The HR folks belong to the same organizations and attend the same professional functions. In Houston the chemical guy / gals ( HR ) have lunch together once a month ( trade groups ) to discuss trends etc. Who's hiring, who's laying off etc. Again, foolish to think employees, prospects etc are not discussed.

Pay a lawyer to rattle his sword and straighten the guy out and then do better research on who you jump into bed with.

Not splitting hairs. There is a large difference between a company policy, and a law. A company can say anything that is truthful to the next employer, and not break any laws.

Thats right, privacy law sez you can sue your boss if he/she is doing anything other than affirming you have worked there. You can set up a sting through some private enterprises that cold call employers and act like they are potential employers. Your bosses message is then recorded, and you go get a good civil attorney if your former employer is outside the law.
