You can’t charge him for anything unless it states it in the rate con. Honestly, this was your mistake ultimately anyway. You should have recovered it when he said he couldn’t get to it that first day.

I’ll throw some assumptions out there that may or may not be true.

    1. Your a young baby brokerage
    2. Your rates are really low in order to win your customer.
    3. You stuck it out with this guy because it’s hard to find trucks to take the load at the price you have it.

Blame him all you want but you got a business to run and a customer to keep happy. Find another truck.

It's not abandoned load. Driver didn't sign BOL. Not showing up is correct word.

Why do I get the feeling we're not getting the entire story here? O/O doesn't show up for a load booked by a broker that owes him money for previous jobs? My guess is the O/O is being strung along and decided not to accept a load until he was paid for the previous jobs. How long ago was the broker invoiced for the owed funds?

Doubt we'll get any proper answers, Steve. Dude likes to post silly stuff and disappear for months. Go check out his post history- it's somethin'.

You can only abandoned if you pick up the load, drop a load are not going to pick up a load is not the same, if you owe him money from a different load you can charge him back if you have it on your rate con that he sign, that is the only way you can charge him, if it’s not on the rate con he sign you have nothing

YOU ABSOLUTELY CAN NOT HOLD HIS MONEY UNLESS ITS A CLAIM, CERTAINLY NOT FOR FALLING OUT OR NOT PICKING UP. ALSO THAT YOURE ASKING TO KEEP HIS MONEY OVER NOT PICKING UP A LOAD IS SUSPECT AND I WOULDNT WORK WITH YOU ON THOSE GROUNDS ALONE. NOW THE GUY WHO ROLLED HIS TRUCK WITH MY PRODUCE HAS HIS 50K ON HOLD. A BROKER IS THE AGENT OF THE CUSTOMER AND TECHNICALLY CANT EVEN CHARGE A LATE FEE WITHOUT THE CUSTOMER SENDING IT. AND WE CERTAINLY CANT KEEP ANY LATE FEES YOU PAY UNLESS YOU SIGN AN UPDATED RATE CON.
