Some companies require 100 miles drivers to log even though it's not required. Once you start, you are stuck with it. Either way, you have to show proof of the previous 7 days start and stop times so the DOT can see what you've done.
Central Transport is one of them companies. Because they have most drivers running local, some line haul and a few OTR, they make everyone log. -
That's if town is 100 miles wide.

395.7 is hard to read because that page is blank.
You meant 395.3 and 395.8 which is for the big boys.
395.1e is local exemptions -

LOL Sorry... I was just going by my (bad) memory.
Its 395.8 "(1) Every driver who operates a commercial motor vehicle shall record his/her duty status, in duplicate, for each 24-hour period."
The 2005 HOS rule did away with the "local driver exemption".CondoCruiser Thanks this. -

fact is if the officer doesn't do the inspection properly it's unconstitutional... They are not allowed to make rules and regs. as they go.
Go blow smoke on someone who doesn't know or is affraid of big bad ray and the FMSCA.
Police are the most corrupt out there... I done seen it with my own eyes when i was doing that kind of work.
I even helped get a prosecutor disbarred he was smoking rocks in the courthouse bathroom.
So throw up praise for those you worship and get your ship of fools to follow you to utopia.
Read the original post it's not stated wether driver is local or OTR driver. And most of the guys don't know whats in all the rules, hell the police only know one or two of their favorites to bother you with. So you can't say for sure if it was a justfied OOS or not. Not enough facts presented.
You're assuming facts not in evidence.
If he's given a fine he'd have had the oppurtunity to have his side presented and verdict reached. I'd be willing to bet the OOS was so questionable this officer was scared to go to court with it. Most are only good when they have a prosecutor to try and cover their lies. The one thing for sure is the biggest cheerleaaders are always the biggest crybabies when they get caught. So it maybe a year or two but at some point in time you'll be crying be whining about your rights, it never fails. -
