Log book vs. 100 mile radius rule

I agree with all of the above except you don't "have to" take a 34 hour reset.

 

I have not seen anything in the HOS rules about a 100 air mile radius driver being exempt from a 34 hour restart, only a construction exemption lowering the restart to 24 hours.

Could you please show me somewhere that states otherwise ?

No one is required to take a reset.

Even local drivers working under the 100 air-mile rule are eligible to take one as long as they meet the criteria for taking a reset.

 

Local or OTR drivers are not exempt from the 34 hour reset, they are just not required to take one.

 

This is how it runs for me as a local in Cali.

i am on a time card and I do run around 450-500 miles a day. I am legal for a 16 hour day and do not have to take a 30 minute break. Even tho I am on time card still got to run logs.

but when I was really local I didn't go over 80 miles a day. I still drove withn the radius and when you're withn the 100 air mile radius you can drive circles for a month if you wanted to you're not breaking any laws.

now some days i will cover the Reno guy which will have me crossing from ca to nv. So now I am on a 14 hour clock and have to take my 30min. Now let's say I only did one trip across border line and for the rest of the week I am staying only in California.. We'll I still have to go by the 14 hour clock and 30 min break because I crossed the border in one work week until my reset.

 

Unless CA rules are different crossing a border has nothing to do with the FMCSA local driver rules. If you have to use a RODS for one day you don't have to continue using it for the rest of the week, you only have to use it for that one day.

 

How exactly can you do that legally? Did your boss tell you that was OK, or did you hear that from a DOT officer or find it within the rules? If possible, I'd love to be able to legally skip that 30-minute unpaid break. Thnx.

 

Like Sublime said border crossings do not affect your HOS and....what do you mean you are on a 16 hour day? Are you running intrastate most of the time? I believe that the rules down there limit you to 15 hour days with a limit of 12 hours driving, with 8 off duty.....for intrastate.

 

the officer said if you're a intrastate driver all week and u end up going across the border your hours change until the reset

Not my boss we have driver meetings every 6 months with commercial highway patrol and that's exactly what we were told 16 hour days no 30 min break. Not sure if 8 or 10 hour off duty but I get my 10 no matter what.

I am only intrastate but once now and then I'll cover someone's route and that'll be Sacramento to reno and once I go over I have to change my hours from 16 to 14 just like all otr drivers

 

If that's a California rule I won't dispute what he said but it's not an FMCSA rule.
