is logged as on duty not driving so you would still have half an hour to drive before you take your 10. And what about your post trip? You're supposed to show a post trip also. Since you took 10 straight hours off duty, you can drive 11 hours now....provided you have available hours. Midnight has nothing to do with it in this case. Midnight is a factor if you're short on hours.........and when midnite rolls around you pick up hours at midnite.

so as of midnight you would still have 8.5 of driving time before you take your 10.

According to the FMCSA and the NC Highway Patrol Motor Carrier Enforcement and the Mississippi DOT Enforcement, The PRE TRIP is NOT, NOT, NOT, NOT required to be logged on line 4 - on duty, not driving. The POST-TRIP Inspection however IS required to be logged for 15 minutes. This is not a matter to be argued as it has been settled and is law. The DOT WILL NOT write you a citation or fail your inspection EVER, for not logging 15 minutes for a pre trip. You guys seem to think you know it all, or at least more than the cops and probably deserve the ticket when you screw up. I asked numerous people in the enforcement community when this first came up and got the same answer from each. You want to do it different, go ahead, but DON'T tell people they will get in trouble for not doing it your way. The scare tactics are expected from politicians, not other drivers.
BTW, The DOT does not enforce that little green book your company gives you in orientation or that you pick up at the truck stop. They are enforcing what is known as regulatory guidance and interpretations which are basically an addendum to the green book and spell out the law, not just the law itself. If you need to see what they are actually enforcing including questions and answer, get the big(8 1/2x11) green book by J.J. Keller the includes all of the Q&A and guidance in it(This is what the DOT is using).
