Unfortunately the prisons are crowded with folks who did not give a "second thought", maybe not a first thought.
Criminal charges are one thing. If you get the pants sued off you in Civil Court because you were involved in an accident while you were over HOS limits (or "driving like an idiot"), you may not ever own anything ever again.

You are contradicting yourself. If you have a pair to say no to a carrier without the logbook why can't you say that now. Where is the difference. At least with the log book you can use it to say no. Did you ever consider that you can log 15 minutes every 4 hours when you check back in with dispatch (working) for your next load. You do have control if you grow a pair and stand up for yourself.

It would take time to get it all figured out. What penalties for what offenses. How stiff the fines would be. What would merit losing your cdl and for how long or even jail terms. Or all of the above. But if this was used as a precipice before enacting it and all these things were made clear before hand, then no one would have any excuse. And I hate to point it out, but, how many deaths do you think will occur because of open borders? Do you think it's going to be a level playing field? Something needs to be done. If a driver knew, for a hypothetical example, "If a driver _______________ (fill in the blank) he/she will be fined $1,000 or $10,000 or $100,000 and imprisoned for no less than 1 or 3 or 5 or 10 years and lose all CDL licenses and priveleges for 6 months or a year or permanently", don't you think that would be a huge wake up call? It would take a great deal of thought and consideration but it could be done and in the long run if it was stuck to with no tolerance, it would be highly effective. Drive safe or else. Period. End of discussion. High prices and consequences teach discipline very well.

Yatista...I've said no many a time. Still alive and never hurt anyone because of it. Thank God. But the fact still remains after that...crap loads, low miles, sit sit sit sit sit, because of a pissed off dispatcher. If you've never had that happen....well...

Financial penalties will mean very little as most will not be able to pay anyways. Jails are already overcrowded and putting truckers away will just add to the numbers. So then we'd be looking at the cost of building new prison's or figuring out what other criminals to release. This will cause even more issues and cost significantly more money.

I don't believe that the numbers of drivers with jail terms would be that high when people see it's no joke. And I don't want to see anyone go to jail. I'd never wish that on anyone. God forbid. But if I break in your house do I deserve to go to jail, if I even get out alive without you blowing my head off? Yes I do. Same thing. Don't do it and you don't have to worry about it. I try to believe all these regulations are for "safety", but I really have a hard time with that. We're at their mercy out there. The drivers get caught right smack in the middle between everybody. Carriers, shippers, receivers, D.O.T., everybody all at once. There's got to be a better way. And total government control is NOT the answer. We need laws, that's a must, but this is getting out of control.
Injun Thanks this. -
we're not even close to total government control. That would super cool tho. When they make movies like that I enjoy them, total control gets to be very similiar to zero control.

It's moving toward it rapidly in the trucking world with the legislation that these lobbyists are pushing for. E-Logs in every truck on the road, every truck governed, 40 hour work week for ALL truckers even OTR. What are you gonna do then? Stay OTR? You tell me what's gonna happen.
-
Well, this could be debated for a long long time. I stated my opinion and I stand by it. It's peoples right to disagree, so at least we can agree to disagree. It would take a lot of work but it would be safer when the bugs got worked out. Choice NOT force.
Until next time, God bless and be safe. -
If you worry about every piece of proposed legislation you'll go crazy. Elogs don't do anything but record what you did, kind of like what you are supposed to be doing on your paper log. I can't see any reason why governing a truck would make things safer, it doesn't stop you from speeding. 40 hours a week is more than I work now, so I hope I don't have to step up.
