Logging off duty when in sleeper. Yes or no?

    Is it in the regs? Nope. But it IS published in the official guidance of how the regs are to be interpreted.

    Incorrect. The regs say you need 10 hours of sleeper berth, 10 hours off duty or a combination of off duty and sleeper berth which totals 10 hours.

    well if he told him he was in a motel and logged it all as sleeper he still would have been nailed for false log...as being in a motel one needs to log off duty.

    too much time in sleeper too can get you nailed for false log as they will ask you didn't have to goto the bathroom, eat...etc..etc... (if you get one of those big condo sleeper trucks that is fully self contained you probably could get away with it.)

    Yes, you have a restriction to wear your contacts while driving. You weren't driving, you were standing in the scale house talking to the DOT Cop. You should have told him, "I took them out because of dust blowing here, and will put them back in before leaving in the truck."
    If he had pulled you over on the road and ran up to the tractor and asked about your contacts, and you didn't have them in, he would have had you, but he didn't, he asked you while you were standing in a building.

    Or,did I miss something?

    Well thank you for that. That must of been the big book he showed me. No one ever showed me the guidance part of the regs. Guess the case is closed so to speak. Still BS in my book.

    Sleeper Berth Provision
    Drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus a separate 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.

    Its literal!

    This is only if you a doing the 8-2 split. For a regular 10 hr break you have to show 10 hrs. Off duty, sleeper or any combination of the two.

    Is it really literal? You apparently haven't read the original post where it says that I was off duty for almost 24 hours!! Duh!!!

    yes, but it doesn't say you HAVE, again HAVE to log sleeper berth.

    I always log off duty for 10 hours. always have, except for the days of 10 driving and 8 off, never have been questioned by any dot stop or any company I have ever been leased to.

    the op was a question and answered it the wrong way, plain and simple.

    why would that be , if ya took less than fifteen minutes to go to bathroom, let me guess you have to flag that, I can see it now, a flag with the notation "took a schizz"
