Logging Question - "Rollback Hours"?

    And there are several horror stories floating around here that illustrate this point well. The one I most remember is the guy in Georgia who wound up losing everything he owned because he "got creative"

    The way understand that story, he legally ran out of hours about 3 hours from the house, but he kept going. When he got home he parked the truck in front of his house, went inside and went to bed.

    Later that night, two drunk guys in a pickup truck came along and plowed into the back of his trailer, which killed them both. Since a commercial vehicle was involved, so to speak, the Georgia state DOT was called in. They banged on the guy's door, awakening him, and asked for his logbook. He was found responsible for that crash and the fatalities, because according to his logbook he wasn't legally supposed to be there, and if he wasn't there the pickup truck would have simply ended up in his yard.

    An opposing attorney got ahold of that information, and sued him on behalf of the two dead guys' families. The resulting judgements cost him everything he owned.

    In no way was I advocating people "getting creative" and I would never tell my son to. Unfortunately, many people do, and my son seems to run into them a lot....however, he does not take their "advice".

    I just wanted to know if doing a 34 is normal for a three week out period...actually, doing 2 34s.

    He has been logging like he is driving, but has had a few bad loads already (one load) the trailer he is supposed to haul is not at the terminal.....another load) out of Beeville TX that turned out to be a guy's house, no directions, just a road...another load) was late BEFORE he even picked it up..etc. These situations ate up much of his on-duty time while he tried to figure out what was going on).

    One of the dispatchers questioned his need for another 34 even though his logbook shows he will need on in a day or so. However, I think the guy is just being difficult as I have read that they just worry about the load and not the drivers situation...true or not true?

    this is where the Qualcomm comes into play. if he is sending the company his total hours for the day, i can assure you that someone is indeed watching his hours at the company. if he has 14 hours left, then his butt had beter be driving those 11 hours like he's supposed to, no excuses, like his trailer was the wrong one, or some guy's house, or whatever. the company is "reading" his log he is sending them. this is why the dispatcher is challenging his hours and a need for 34 hours off.

    yes, they really do only care about the loads, but when a company see's something wrong in the logs, they will take corrective action(s) up to and including firing........

    OK, IF his log book says he needs to do a restart, then you should look at what day he is on in his 70 and 8 cycle.....if he is on day 7 and has 15 hours he can run for the next 2 days at like 7.25 hrs per day TOTAL, then on the 9th day he will get a new set of 70 hours to run off of....if he is on say day 5 and only has 15 hours then yeah he is gonna end up doing a restart because his hours will be gone before he gets to the 9th day of the cycle......it sounds way more complicated than it is and it can get to be so convuluted that there seems no right answer but there is......70 hours is 70 hours if you use them up in 5 days and have to sit for 34 hours of if you make them last 8 days and never have to sit.....being new it will take him some time to figure all this out.

    Ok on his 8th day if he has 15 hours available and he uses 10 of those hours by "Midnight". He still has 5 hours he did not use PLUS what hours he has on line 1.
    So in my example I e-mailed (the first re-cap) you lets say the driver did not work the 7.75 hours; well at midnight (end of the day) he will have the 7.75 hours Plus (line #1) 3 hours. If he can get started on a load with those hours then he can get trucking. Why not take a full 34 well after midnight he has hours to work that day and you can see (line 2, line 3, line 4 etc) he is going to gain @ LEAST 10 HOURS almost every day.

    Now if I had (on my recap e-mail) line 1 (4) line 2 (3) line 3 (5) then it would have been best to do a restart.

    If he does the recap the way I e-mailed you and his hours available are very low and lines 1 going down are very small #'s then he would probably be best off doing a restart!

    Here look at the 1-9 recap
    The recap on the 9th he doesn't have but 3 hours available, but at midnight he will start gaining those hours to run every night at midnight so he doesn't need the restart.

    Every day he is starting is his 8th day. Once he takes a 34 hour break off he gets a new 70. Go back 7, the day he is on is his 8th day (always) if them hours total more than 70 he is in violation. :hello1: I am cheering you on here!
