I am relatively new driver, [4 mos} heres the short version of what happen. i took a load to nyc, got stuck in traffic on the way out and ran over my 14, mileage to time wise on paper i can make it legal, but i am afraid if i do that and get caught i will get fired for falsifying logs, but if i do show the violation on paper i could get fired for that. i'm wondering if they can track that on the qc. what is the best choice, as i have not yet scanned my logs for this trip?

if they believe that there is some thing wrong yes the can look on your QC I would not turn in logs with violations it is up to you but I would make my log look go and legal

i was thinking of just logging that i started the day later than i actually did i had one fuel stop and can log it at the right time as i know they do check if your logs show the correct fueling time, im just afraid that if they tracked me starting when i did, and i don't log it right that would be worse than just logging a violation

thanks for your reply, rock and a hard place i reckon. in that situation what should i have done, besides a better trip plan. as i couldnt find a safe haven. truck parking in nyc is a bit scarce.

They can definitely track it on the Qualcomm . I've gotten notices asking me to explain slight discrepancies in my logs months ago . You should have sent a message on your Qualcomm asking how to handle the situation and done what the response said . I have been given violation notices for improperly splitting sleeper (I thought I did it right . Every other driver I talked to said everybody that splits the sleeper gets a violation ) but there was no penalty .The Federal penalties for exceeding available hours are far less than log book falsification . Both the driver and management could face felony charges if the driver was forced or allowed to falsify logs .
How much were you over the 14 ? If it was me I'd log it as it was run , showing going over , explain why , and hope for the best .
I'm not familiar with your company though . Many companies are well aware drivers fudge logs and some expect and encourage it . The Qualcomm thing complicates it . There's a reason it's there .captK Thanks this. -
i was over 1.5 hours, i also went through a couple of toll booths with the easy pass when i was over hours.

You can TRY using 395.1(b), but given that NYC is known to have gridlock on a rather consistent basis, I doubt it would fly

If you let them know you won't falsify your logs it may make them more careful with your scheduling . Depends on the company but some will knowingly ask the driver to do the impossible knowing the driver will somehow make it look possible .
