Wait, you're attacking people for "opening their mouths', and you are now admitting that you have a cop friend engaging in illegal activity for your benefit, at your request? Does your cop friend understand that what you just posted could get him fired and prosecuted? Oh, and you prosecuted as well. Perhaps some admins need to take a look at this comment as well. As for you requesting someone send you information, that you will have looked up. I'll be happy to submit this info to you, in return, you will submit to me the name, badge number, and dept. name of the agency doing the records search. Let's keep it all above board.

 

I can tell you that your "friend" is speaking about what would happen in his state, and not what would happen in other states. Since you're in Va., and we already know how Va. can be about the rules, at all levels, he should not assume that other states don't give officers some leeway when it comes to how and what they cite for. It's no different than judges and prosecutors.

 

Do you have any idea what training CVSA/MCSAP/DOT officers have to go through just to do inspections? The continuing education that ALL cops have to do? This is a subject that does not translate well to a forum like this. ALL cops go through training in how to trip people up. As I have stated CLEARLY at least 6 times if not more in this thread. Cops often time operate in THE gray area's of the law. One such grey area that I have brought up in here before is a cop is NOT required to tell you they are finished and you are free to go. They will if trying to dig deeper into your story and keep right on asking questions. They are TRAINED to do this. Truck drivers as well as other people that encounter police officers have GOT TO STOP telling these cops their life's stories. Don't make comments about anything. In other words SIERRA-TANGO-FOXTROT-UNIFORM! These laws are complex and I don't know everything about them because I am NOT an attorney. AND NEITHER IS EVERYBODY ELSE PIPING OFF IN THIS THREAD. This is why Attorneys make hundreds of thousands of $$$ a year.

 

One more point. That part you just quoted was about false logs. Of all the things a driver can do these days HOS wise a false log is the worse. It is a charge that a driver can be ARRESTED for. My friend was telling me that if he cited ANYBODY for a false log and did not create an accompanying state summons there would be hell to pay. That violation noted earlier had no ticket attached. This is something very few states are going to allow.
