OK I contract the Federal Department of Transportation and ask them about all of this. As soon as the reply I will copy and past their reply here for you. So stop being so nasty. There is no call for it. And I never said a driver sued a shipper I said that we will probably do that if they manage to get us towed. I said that we have talked to several drivers who rand out of hours at a shipper or receivers and they threatened to tow them. They put them on the phone with their companies and once they got off the phone they left the driver alone until he got his hours back. However I did not go into that much detail.

Shippers/Receivers can threaten to have you arrested for trespassing, however I don't really think they will be successful. Speaking as a former LEO, to trespass they should not have allowed you onto their property. If they do call the cops, wait politely, and then explain to the officer that you had permission and were authorized to be on the property. That it was the shipper/receiver that caused this problem now, not you. That their taking umpteen hours to load you put you in this situation. Explain that the federal regulations/laws prohibit you from driving, and that he (the officer) would be circumventing that law. Let the officer know that you would have gladly moved off the property hours ago when you could have legally done so, but the shipper/receiver would not allow you to, since they were in the process of loading/unloading.

The U.S. Marshall Service have not and will not do anything. That is not their function, and never has been. I've got a very good friend that is a U.S. Marshall, not just a Deputy U.S. Marshall. I would think anyone that is a shipper/receiver hears a driver threatening to call them, would be laughing their butts off. If you said that you were going to call them to me, I would simply say, please do, I'll wait patiently for them.
I've dealt with similar threats of trespassing, where the person was invited or had permission to be where they were. The for some reason, (one being a deliberate intent to just get someone arrested), the property owner suddenly tells the person to get of their property. It shouldn't work out to the property owner's advantage. If you notice I emphasized shouldn't, as not all LEOs will see the trespass laws objectively.
Put the burden where it belongs, and maybe when the shippers/receivers see that they can't have it both ways, they'll start getting trucks loaded/unloaded in a timely fashion. If they don't, they will have docks being tied up as parking places for drivers. Not a simple solution I know. Maybe get some lawyers into the mix going after the shippers/receivers, defending some driver's actions if they get arrested by some zealous, ignorant LEOs, could help to get this turned around. That along with expensive detention fees charged to the shipper/receiver.
Last month another driver and I loaded at Ash Grove in Chanute, KS. Just 5 mins after I was loaded, the receiver (construction company) cancelled the loads due to the forecast for rain. We both now have bulk dust with nowhere to go with it, and they will not allow us to just dump it off. This is CKD (Concrete Kiln Dust), we haul it in end-dumps. If we dumped it on the ground, once moisture gets to it, it begins to setup, and it will turn solid. It's used to stabilize soil, make it real hard. So anyway, our company had us make out a BOL, charging Ash Grove $50 per hour, per truck, for us to sit there until they can find a receiver for the dust, or they allow us to dump it. It only took about 2 hrs for another construction company to take the loads. They were not concerned about the "detention cost", as this more than likely will be directed to the receiver that cancelled the loads. I will say that Ash Grove is very, very good with getting us loaded, and very accommodating, allowing us to park when we're out of hours. If their equipment malfunctions and the dust gets all over our truck or trailer, they have no problem paying a couple hundred $$$ to have them professionally cleaned. Even though I don't really like hauling the stuff, Ash Grove in Chanute is one of the best when it comes to taking care of the drivers.
Longest unload, Bunge in Emporia, KS. During harvest when the soybeans are moving is nothing to wait hours. My longest has been 4 hrs, which is nothing compared to the days you all have to put up with. This past week it's been 1.5 to 2.5 hrs.Last edited: Oct 21, 2012

What you're omitting is that the officer is a human being. The rest of what I posted, the explanation to the officer on the totality of the circumstances, is what the officer will base his decision and discretion on. Laws have been written that are not always followed to the letter. Common sense reasoning might be required. The total circumstances show that the shipper's actions caused the problem, not you. If you're not willing to stand up against their wrongful actions, then I don't have any empathy or sympathy for you.

, I wonder if the carriers started charging massive fees if the loading times would improve. I mean after 2 hrs, they get socked with $200 per hour a truck sits waiting. If it goes beyond 10 hrs, the fee goes to $500 per hour. I know of one time I got loaded with Kiln Dust, and the load was cancelled. It was me and another truck. My company had us make out BOLs, charging them $150 per hour while we sat and waited on them to figure out what to do with the loads. They were not allowing us to just dump it off. Needless to say, in a short time we had some place to go.
