    With barcodes and computer records now when you got the duplicate license you may have invalidated or flagged your original license as not in your possession.

    It really depends on the COP who stops you. By law, you need your CDL in your possession while driving a CMV. Just as you need your D/L in your possession while driving your POV. However, if a COP can confirm your identity and your drivers license status (hopefully valid) he might let you boogie on down the highway with just a citation. But what happens if you get stopped again 100 miles down the road ?

    I posted the regulation above. Yes, it is a serious offense to not have your CDL in your possession, however right there in the regulations it states that you shall not be guilty of the offense if you provide proof that you had a valid CDL on the day you were stopped, it just wasn't with you at that time. Serious offenses only count towards disqualification if you are convicted. Not guilty = no conviction. So it really doesn't matter if you get 100 citations during the few days it might take you to make your way home to get a duplicate CDL from your home state's DMV....all you need to do is send proof that your CDL was valid on the days you were stopped to each of the jurisdictions which cited you prior to your court date and you will be found "not guilty".
