So I delivered to a facility the other day, and the lumper fees were not prepaid. I felt that this was a good opportunity for me to tap into my secondary revenue stream, so I inquired about the charges. When the price was quoted, I told them 'thanks, I'll unload it myself'. Clerk told me "This is a lumper only facility, you can't unload your own truck". Really? I mentioned that I'd never come across a 'lumper only' facility, and could he clarify? "Over 100 cases and you have to hire a lumper, you can't unload yourself".
I do believe that this is illegal under Federal law. I'm considering filling out the complaint form and getting a Federal investigation started into this facility's practices.
Is it worth it, or is this one of those battles that I should walk away from?
"Lumper Only" facility?

The Federal form is on their web site, along with an article about the legality of forced lumpers.

Tell you what...it is YOUR freight. If YOU want it, YOU can pay to have it unloaded, just like YOU paid to have me bring it here. If YOU are unwilling to have YOUR freight unloaded here, YOU can pay the return freight as well as the shipper's restocking fee (which the company YOU ordered this shipment from will be GLAD to bill you upon its return to them)...and then YOU can pay for another truck to bring you this freight that YOU ordered. Makes no difference to me. I'll get paid to haul it back just like I got paid to haul it down here. What is NOT going to happen, though, is any money coming out of my pocket to pay YOU to unload your own #### freight. You've got 10 minutes to decide, and if you aren't ready to unload your freight by then, you'll be seeing my tail lights and can expect a pretty sizable bill from the shipper to cover the round-trip shipment.amscontr, aiwiron, BigByrd47119 and 3 others Thank this.

Nothing quiet as much fun as the good ol grocery warehouse shuffle.. Me personally, I'd pull out all the stops and call in a federal marshal posse.
Ukumfe Thanks this. -
i would file a complaint. i personnally think that the idea of haveing to hire a lumper is wrong anyway. a reciver should have to take delivery of the freight as the shipper sent it. if they want it stacked to a certain spec for thier warehouse then let them pay for it. Most lumper fees are just to keep the labor cost of the reciever down anyway. it is just a way to get around having to hire employees to do the work. if they want someone else to do the work then let the reciever hire the lumper as a 1099.

Oh yea, the Federal Marshall! That's always good for a few laughs, even though that joke is over 40 years old, it still gets a few snickers at the lunchcounter.
