Thanks, everyone. I am going to do it. I average 3k miles a week and home every night. I have Sunday off and it's just depressing sitting at home and watching trucks go by my window. Lol

That's what I was thinking as well. I dont see how operating a regular car can count towards a commercial drivers 70 hours. You'd think the two would he looked at separately.passport220 Thanks this.

You are being compensated.
If a driver takes a second job with a non-motor carrier, do those hours affect compliance with the hours-of-service rules?
Yes. Under 49 CFR §395.8(a), drivers must record their duty status for each 24 hour period, including all on-duty time. The definition of "on-duty time" in §395.2 includes "performing any compensated work for a person who is not a motor carrier." Therefore, all compensated work, whether for a motor carrier or not, must be included on the log as on-duty time and counted against the driver's available hours.
The actual text of the law
On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On-duty time shall include:
(8) Performing any other work in the capacity, employ, or service of, a motor carrier; and
(9) Performing any compensated work for a person who is not a motor carrier. -
You can't make as much money driving for Lyft or Uber as I can driving a truck. Even during a surge, I will make more just turning my key and pointing my truck in the right direction.

No one in their right mind is going to log making some extra cash on the side. I don't care if it's legal or illegal to log it; if I want to spend weekends catching grouper and selling them to restaurants for extra cash, I'm going to do it and it's not going to count against my 70 hours trucking.
The reason I mention catching grouper is I know a guy that does just that and sometimes makes a few hundred dollars, tax free, on weekends while doing his reset.
If a neighbor gives me a $20 dollar bill to mow his lawn, I'm not going to report it to the IRS or log it.

I have a friend that does that with Uber and Lyft. He's signed up with both. It's like a hobby for him and he really enjoys it; looks forward to the weekends because of it. Some people like fishing or watching ball games and some like driving for Uber or Lyft. He shuts down at 11 pm because he doesn't like dealing with drunks, but the rest of the time he really enjoys it.bottomdumpin Thanks this.

Not saying that I would log it but that is the law. They asked about the legality of it.

Most people don't log half the work they did in their truck, let alone their side hustle lol

ANY JOB counts against your 70 if you want to obey the regulations.
