    Reread § 382.303 that I posted above. No drug test is required if he was not cited for the wreck...unless there was a fatality.

    How long did it take you to get clean from the time you stoped? I smoked for about 9 years and recently(1.5 months) STOPED! cause it aint worth it by no means....just part of growing up.

    "or"

    There is a drug test requirement if any vehicle is towed.

    Even in the section you quoted.

    We had a driver that had a lady pull out infront of him on Highway 1 south of Valley City ND. She went through a stop sign. He did not get cited for ANYTHING but was ordered to take a drug test.

    Back in my younger days, I used to smoke the funny stuff. I used to drink quite often also. I quite the smoke many many years ago so that is not an issue with me. Found better things to spend my cash on. When I got my CDL then my drinking also diminished to almost nothing. You can get put out of service even if you have a hangover from the night before. A hangover means that you are still under the effects of the alcohol and this is grounds for DOT to put you out of service for up to 24 hours. You may not get a dui but you can still get put out of service.

    Well I can't rightly say as I was not tested till several years later.
    I know it takes about a month clean to pass a UA and I believe about 90 days for a hair follicle test.

    no differnt than drinking, freind of mine drank to heavy over a weekend was in reck 2 days later they did blood test he was still charged with dui. or maybee his story wasnt the full story. but either way your gambling

    The reading comprehension skills around here are somewhat lacking....

    Let's look at it again:

    OK...so this first part is dealing with alcohol testing.

    If the crash involved a loss of life, the CMV driver gets tested for alcohol whether he was cited or not.

    This is a 2-part section. Subsections (i) and (ii) ONLY come into play after the driver receives a citation for the crash within 8 hours of the occurrence.

    This second part deals with drug testing for controlled substances.

    Again, as with alcohol testing, it doesn't matter if the CMV driver was cited or not, if there was a fatality, a drug test is required.

    Again, this is a 2-part subsection. Unless the above (2) is met, the below (i) & (ii) do not apply. (2) requires that a citation is issued within 32 hours. Once a citation is issued, then a drug test is required if:

    So yeah, I see your word "or" in there...but it is irrelevant if no citation was issued.

    Try reading it again.


    I went to another part of their site and it does state when cited.

    However, a timing issue is probably the problem with waiting for citing.

    The company MUST drug test you pre-employment, under certain post-incident situations, random, and "for cause".

    The company MAY choose to have higher standards for drug testing than what is required by the DOT. If company policy is to drug test if you break a fingernail, that is their choice....you can either abide by their policies and higher standards, or seek employment elsewhere.

    Just like some carriers are now using hair follicle tests. These tests are IN ADDITION TO the DOT required urine test, not in place of. The FMCSR mandate the urine tests, and so to be compliant the carriers must still use the urine tests to meet the DOT's drug testing requirements. Motor carriers are free to have higher standards if they so choose....they just can't lower them beyond what the DOT requires in the FMCSR.
