OK. Someone explain this to me because it seems blatantly illegal.
I show up at the drop site and it's a complete cluster F, taking six hours to unload me. Two hours, per Marten policy, are free and the rest are paid at $20/hour.
I get a message from my driver manager that they're only paying me $20 because I only had three hours of my 14 hour clock left.
(3-2 free hours= 1 hr., which = $20)
How is this not stealing?!?!
What difference does it make if I have three hours left to run?!? Marten is still getting paid detention (over and above what they are paying me) they're just coming up with an irrelevant excuse to cut me out of the money. The truck isn't going to start moving by remote control from Mondovi just because my 14 hour clock is out.
Wondering if this is something that an attorney would take on as a class action case. Suggestions?

Marten's detention policy per page 203 of the March 2013 employee handbook states:
"Employees who arrive on time and are delayed by a shipper or receiver for more than two hours beyond
the scheduled appointment time will automatically receive a message stating detention pay of $20.00 per
hour will be paid pending verification of paperwork. Once paperwork has been verified assuring
accurate bill of lading times and signatures, detention will be paid for every hour detained based upon
drivers remaining hours available on their 11/14/70 clock at appointment time, paying the lessor of the
11/14/70 remaining, maxing out at 9 hrs. The employee will receive the detention pay when paid for that
trip."

It does say dependent on your 11/14/70 in the part you copied...... but it is a screw job .
Next time try to show up at shipper/ receiver with a bunch of hours left on the clock...... And see what excuses they come up with then.... -

There is no reason the driver wouldn't show all the hours on their logs since they aren't getting paid by the mile, they don't have to cheat on the hours so they can get some money for their time. They would put the correct hours on the logs so they would get paid the hours they worked. -
Next time since Martin wants to play dirty,the very second your 14 is up,tell the customer to stop unloading.It looks like the policy does state that.But since it's all about the HOS to Martin,you do the same.Or just don't send in your mt call till you have fresh hrs.

Because Martin does not want to pay once your hrs are up so send in your mt call after your 10 hr brk.Martin should have paid him 4 hrs not 1 because hes out of hrs.Hes still sitting at the dock,why not pay him all detention?So heck with it,I cant send in my mt call because im out of hrs.

I'm sure they'd be thrilled with the customer complaint since trucking companies only have one product and that is service to customers.. I'm sure getting tossed off customer property would also be a great thing to aid in the driver's assistance to seek other employment opportunities.
Get mad at the company, work with the company to fix things... screw around with the very source of your income.. not very wise. -
Oh yea that's a great solution, get held up at a shipper for 12 hours waiting to get loaded. Show all hours fine 12 ODND, took me an hour to get there that's 13 total .25 pti, .25pti there's 13.5 so I have a whopping half hour left. Great solution puts me a day behind right out of the gate. Yep if I was hourly I would've collected a check at the end of the week turned in my truck keys and everything and had to go right on down the road because I wouldn't have a job.
See my point?
For somebody that just said in his last point screwing around with your source of income isn't very smart your solution isn't very smart either. Even if he was to run over on his ODND which he can legally do guess what he still would've been Sol because he's behind the 8 ball for tomorrow because of his 10 hour break. Any way you look at it you're screwing with the people that sign your paycheck. Collect all your detention by showing your hours, then you're behind for tomorrow, fight and say I want all my detention doesnt matter your in a lose lose situation.
See what I'm getting at? I never have recoeved detention probably never will doesn't bother me want to take 6,8, or even10 hours to unload me fine iI'll go to sleep. Works fine for me but I'm also not paid by the mile as a company driver but as a company driver you and always go to sleep and be ready for the morning.MartenMan Thanks this.
