Oh, I do from the first physical, just not the second. That's what I thought Moose1958 was talking about.

I'm talking about ALL your current physicals. The point is (listen up) you MUST not allow 2 separate physicals to be placed in the examiner database with substantial differences. It is perfectly OK to get a 2nd opinion if an examiner refuses to give you a card. The FMCSA is not concerned about that. What they DON'T WANT is for you to doctor shop. This means if you decide later to seek another physical YOU MUST make sure the examiner has been made aware of the previous physical where you were not give a card and WHY! This leaves it up to the 2nd examiner to decide is a card is warranted given all the information. This is why it is so dang important to know what that 2nd examiner did and hence my comment about NEVER UNDER ANY CIRCUMSTANCES leave a physical without a long form EVEN if a card is not given to you. This 2nd examiner might not have made any entries into the database, but at this point you can't be sure and must act as if he did. You have the potential here of screwing yourself right into the ground on this. Be careful about what you do next and be totally honest.

I thought there wasn't a medical examiner database yet. Did one get implimented in the last year? I know dot was looking into it, but nothing yet.

Yes, All FMCSA registered Medical Examiners have a log in into the system where they enter the physicals. I think what you are refering to more is this system hooked up with the states that make it to where a driver does not have to actually carry a medical card. At this point I do not know where the FMCSA is on this at this point in time. However make no mistake, the FMCSA medical Examiner data entry system is in full use at this point.

Just one more point before I go do something else. There are exceptions of course by by in large the largest problem drivers are faced with in being denied medical cards is the result of bad nutrition choices and this sedimentary lifestyle a lot of drivers choose to live. The FMCSA is dead serious about these standards and the Medical Examiners are starting to cull drivers out that don't meet them. I know several drivers today that are ex drivers because of this change. Get used to it folks, getting angry is not going to make it go away, and doctor shopping is not going to be a long term solution either, it is what it is.
I don't like this incestuous relationship between the carriers, clinics, sleep labs and the CPAP breathing machine industry. I think at some point legal action will be needed to stamp this crap out. In the MEAN TIME simply REFUSE to play this game. The FMCSA has NO ( zero) Sleep Apnea guidelines (and have clearly stated at the present there will be none), only that a Medical Examiner needs to be sure the driver is getting good sleep and is not suffering from the effects. THAT IS ALL. A simple are you sleeping well and look in at a drivers throat is enough to do this. My last physical was given to me by Dr Anita Sager at the Hampton Va Veterans Hospital. I am sorry to report she has retired. She did this. Looked at my throat and asked me how I was sleeping. There is NO RULE published by the FMCSA about body mass or neck size. If you are confronted by an idiot examiner that implies otherwise correct them and WALK OUT! -
Yes, the info you give to the 2nd doctor has to be the same. But you do not have to tell him about the first physical. From OOIDA website:
When a driver goes to more than one medical examiner, this shows up in the certified medical examiner database. It will be reviewed. If the driver gave the same information to both examiners it is not a problem and the most recent exam will be the drivers current status. If the information the driver provided is not consistent this will be followed up on and if found to be dishonest can result in disqualification. -
You quoted that part accurately. However you also left something VERY important out. How can you go see a 2nd Examiner and NOT list the same information you did on the first one, especially if said information led up to a card being denied? Yes I will grant in a limited scope you do not have to inform the examiner about the first physical HOWEVER you had better #### well list the same information ON BOTH FORMS. Other then this your post is just semantics and nothing about it changes the main idea I was trying to get across.
