    over 10,000 lbs makes the veh subject to cfr 49 . med card required at 26,001 lbs or over . 10,001 with haz mat needs med card .

    I have been stopped by the DOT driving a vehicle with no hazmat and under the 26,001 lbs and the first thing asked for after the license is the medical card.

    391.11 General qualifications of drivers.
    (a) A person shall not drive a commercial motor vehicle unless he/she is qualified to drive a commercial motor vehicle. Except as provided in §391.63, a motor carrier shall not require or permit a person to drive a commercial motor vehicle unless that person is qualified to drive a commercial motor vehicle.

    Commercial motor vehicle (CMV) means a motor vehicle that has any of the following characteristics:
    (1) A gross vehicle weight (GVW), gross vehicle weight rating (GVWR), gross combination weight (GCW), or gross combination weight rating (GCWR) of 4,537 kilograms (10,001 pounds) or more.

    The feds have jurisdiction over D & A testing, CDLs, and HM in interstate/intrastate commerce. For vehicles with a GVWR of 10,001 pounds or more the qualifier is interstate commerce.

    There are at least three definitions of a CMV:

    1. Part 382.105

    2. Part 383.5

    3. Part 390.5

    Definitions 1 & 2 apply to interstate/inrastte commerce. Definition 3 applies to interstate commerce.

    A vehicle may weigh less than 10,001 pounds or 26,001 pounds and still be subject to the rules, i.e. a 1/2 pick-up with a GVWR of 7,500 pounds transporting Class 1.1 explosives. Because Class 1.1 is a Table 1 material a driver must apply placards for any amount transported. The drivr would be subject to D & A testing, and CDL in interstate or intrastate commerce. The driver would be subject to Part 390.5 in interstate commerce.

    My medical card expires Nov 1st

    Can I get the DL-51 form at my local DMV branch? ( because it says to call a # to get it)

    In California what happens if your medical card expires? (In case the DMV doesn't process it before Nov 1st)

    The doctor that gives you the physical will have the forms...

    If this is like the dot medical form. You can google it and download and print it and take it to the doctor. It is what I did. My physical was due the same as when I went for a prescription renewal.

    Stroked550 just go to the DMV office and get the form. I know you can do this because I live in Calif as well. Once your Dr. does the physical take the form down to DMV and they will enter it there. BTW if your Medical expires your CDL will revert to a regular DL. Unless it was changed on me if you take a a filled out form to DMV after it expired it will be reinstated at no charge.

    Stroked, since Nov 1st is on a Sunday, get your physical Friday and then hand carry it to DMV and they will enter it immediately into the system. No charge. Also ask for and get a receipt to CYA.

    Thanks everyone for the info. I got the DL51 this morning there was no line which was nice.

    I got lucky I got a appointment today for my physical so either this afternoon or tomorrow morning I will go to the dmv and turn in the paperwork. I will definitely get a receipt I don't trust the dmv at all

    Hi , in Iowa when i renewed my cdl , they never sayed anything about the card, so my cdl is good till 2012, are you saying its a reg dv then, im getting my new card the 2 nd and hope i pass, thanks Everett:biggrin_25512:
