    my DH was with MidStates when they closed the doors. (He worked for them for 13 years) (getting the truck back was interesting...another story)

    I had contacted the FBI with the insurance stuff years ago and then got bounced to the Dept. of Labor. (and then back when it actually turned into an investigation.) They had told me pretty much too bad so sad with that until they started investigating.....so it just takes enough calls to get them to DO something!

    I'm not surprised they went under I am surprised they stayed open as long as they did! Let me know if you end up doing "something" hubby worked out of LaSalle so we are in the area.

    Hey LaSalle...can you get something organized to do a information picket or just go to Mid States office and call the media to get them out there? It is almost going to have to be someone local to organize this. We have to get the media involved to get somewhere. I talked to the guy in Omaha Neb and he wants someone local to interview. If we can get someone over there to interview with him..that could get the ball rolling. I personally am going to the State Police tomorrow to issue a complaint. My husband was stolen from and we are not sitting down and taking this. I am trying to fight for us and everyone out there. WE NEED OUR MONEY NOW! You people with kids...and without...you need to stand up! Dont let them get away with writing these check and then having our banking institutions take it away from us! You all earned this money and its yours not theirs! It's easy to just say.."we aint going to get anywhere with it so why bother". Some of you organized and tried to become union. If you can do that then this should not be that hard to do... I will do everything I can from here, but being so far away, its hard to do. We have two vehicles and if we need to drive employees down there in our own vehicles we will do it. We are willing to do what ever it takes to make ourselves known to the Hartmans that this time, we are not taking it! Your days of helping yourselves to our money is OVER! Lets somehow get this going and let them know we all want whats coming to us! NOW!

    Two things... One if you do any type of demonstration, make sure you check to see if you need a permit. Two and this is important, make sure who ever talks to media, has his or her facts, and make intelligent comments. I'm sure you all have seen media interviews and it seems like they pick the most unintelligent person they can find. Think before you talk.

    The FBI agent did tell me, it all depends on whether or not a U.S. Prosecuting Attorney wants to prosecute or not.

    So, I drafted a letter to the U.S.ATTORNEY IN Chicago...which I will put in this note. Strait to the point without much side comments and hammered the insurance fraud. The amount of money taken from us to pay for insurance and not being used for that is where I believe our strongest argument lies. Copy, critique, re-do this letter and send it to the Chicago offices...One to the U.S.Attorney and one to the FBI office of KANE county, not King, (my mistake). Hammer it home!!

    Reporting Insurance Fraud​


    I and several hundred other people am the victim of insurance fraud. We have been robbed through deceit by none other than our employer, of all people. The company is Mid-States Express, Inc.

    Mid-States employ 700 to 800 people and is headquartered in Aurora, Illinois doing business in 11 states.

    Mid-States has collected insurance premiums since early 2005 up until late 2008 and has not paid any medical bills.

    It has been estimated during that time period, Mid-States collected $4.4 million dollars and quite possibly more.

    A class action lawsuit was filed to stop this fraudulent activity some time in 2006. Judgment in 2008 was against Mid-States. The court ordered Mid-States to pay the outstanding medical bills. Mid-States informed the court they could only come up with approximately $100,000.

    Where is the remaining $4.3 million they collected from the employees? This question is not being addressed. Under the agreement Mid-States had with its employees, Mid-States was to contribute money to the insurance plan also. WHERE IS THEIR PART? WHERE IS THE MONEY?

    The bottom line is: Mid-States Express collected insurance premiums for a period of 2 years, or longer, and did not pay one medical bill. We the employees are now faced with paying the outstanding medical bills that add up into the millions. Not counting the thousands upon thousands of dollars paid out of pocket to satisfy bill collectors in the short term. Homes are being lost and families torn apart by the apparent mishandling of the money collected for insurance.

    Mid-States Express is hiding behind their corporate status and has recently filed bankruptcy. The owners of this company are the Hartmann Family. They have a long track record of businesses that have been run poorly and one might say questionably.

    When contacting law enforcement and various agencies, we are running into walls. It seems this bankruptcy is clouding the picture. The bankruptcy has nothing to do with the crime of stealing from their employees.

    After the judgment of the class action law suit, Mid-States once again collected, from its employees more insurance premiums offering a new insurance plan with an outside insurance company. As of December 31, 2008, Mid-States canceled the insurance with the outside company; did not say a word to the employees and continued to collect the premiums until the day they filed for bankruptcy. So we, the employees were not covered, yet Mid-States collected our money allowing us to believe we had insurance.

    In closing, a crime or crimes have been committed and those who committed the crimes are being allowed to hide behind their corporate status. NO Law enforcement agency, as of to date, to my knowledge, has been willing to look into this matter and to bring about the justice that is just begging to be brought to the responsible parties.

    They took our money to be used to pay for insurance and used it for something other than to pay our medical bills. This is wrong! I believe it is stealing through deceit and though a law suit was filed and though they have now filed for bankruptcy, I do not believe any of those actions should relieve, nor forgive their actions and the wrongs they have committed towards those who had trust in them, their employees. We were buying insurance not funding the daily operations or any other activity they deemed appropriate.

    Mid-Sates Express, Inc. took money from its employees, telling the employees, Mid-States would provide insurance, for the Employees, and failed to do so. This can not be described any other than to say it is FRAUD.

    Please feel free to contact me, any time day or night. Something has to be done about the horrible wrong that has been perpetrated upon so many undeserving people and families.

    This is good advice. We had a problem or two in La Salle with some miss information when we went first went on strike. It ended up making us look unintelligent in the media eye. The problem is someone who thinks they are intelligent and someone who is intelligent,,,, well lets just say they are not always the same person.

    very well said bill....I am off to the State Police to issue a complaint..I will update as to what they tell me.

In the letter it states, "....the Department may intervene in matters that materially affect the rights of plan participants and beneficiaries and may also intervene to protect plan assets.''

    It says my inquiry has been referred to the Senior investigator for review. ........this process can be very lengthy; therefore they will keep me informed on a quarterly basis. When they have concluded their review, they will notify me and advise me of their dispositioin on the complaint.

    Keep up the efforts...I do believe we are making head way!!

    I did speak with the State Police today. He is checking into the bounced checks and gave me a card to call him with info on the 401k. I Spoke with The Hartford questioning them about if they could tell me when my husbands deductions were sent to them. Seems as though the last deduction they got was from his pay in December. The 26th to be exact. So...that means that all of his deductions since then are still in the hands of Mid States!!!! GO FIGURE!!! Well...I am calling the State Police officer back tomorrow to let him know what I found out. He was VERY interested to hear what I have to report to him after talking to The Hartford. Of course all information has to be gotten from Mid States..Like they will be willing to give it up. But..I bet they give it up of the FEDS show up at their door and want to audit their records!...Also..my friend quoted a verse from the bible and I thought I would share it...now keep in mind..this is from the bible...It is Jeremiah 22:13...Woe to him who builds his house by unrightiousness and his chambers by injustice, who uses his neighbors service without wages and does not give him his pay for his work....Just thought this was fitting!
