You are wrong in that any attorney can not merely jump on board and litigate away.The original attorney that has already started the case or filed it HAS TO allow any other attorney to come on board.IF there really is already an attorney working on this class action,then said attorney needs to be contacted by each potential client or whatever you are,and proceed form that point.IF enough people are involved,multiple attorneys will more than likely have to be utilized UNLESS the law firm is large enough to handle the volume.
IF you know of an attorney already working on this matter,you should post his name OR make it available to whomever needs to know.If this attorney merely publishes his intent somewhere in some magazine or wherever,then many may not be made aware and will lose any potential award/other if a class action lawsuit is brought about and won.

 

I did speak with one of the paralegals from the lawsuit for the WARN class action law suit. What I wanted to know from them is..would filing as an unsecured creditor be in conflict with the class action suit. She said no..and told me that usually employees wages etc are taken care of 1st in a bankruptcy. What I understood they are trying to do is win the law suit and if so, then hopefully they will come next in line before the banks. I am going to a local lawyer just to get some of my questions answered. I dont plan on retaining him for anything. Just a consultation. One of the guys here went to a lawyer and that lawyer told him to file the form with the court that I mentioned in one of my postings to become an unsecured creditor. But do I want to do that and jeopardize my name of not being on the employee list? Will it have an impact weather I do or not? I want his opinion on the 401k info and the life and disablity insurance and how I may go about finding out if our premiums were paid.

 

I totally agree with Jodi242 about not getting anymore attorneys involved with the Class action. We already have attorneys working on the case, why get more involved..makes no sense. The name of the law firm is Outten & Golden based out of New York. Look them up and call to get your name on the list.

 

First of all if you take the time to read post that have been posted for the last two weeks you will find names of attorney that have been retained to work the WARN ACT. You will also find that someone posted the name of the Lawyer who handle the last class action law suit.

Now I am no lawyer but I have one who is watching this case for me. As new things come up she lets me know. The fact remains ... we all have a story to tell, but for some of us we have different endings. I am just saying ... instead of paying 10 attorneys and having 10 lawyers telling us something different let pay two or three. I would like to have some of whats coming to me after all the lawyers are paid.

This is strictly my opinion and if I am wrong then I stand corrected.

NO thank you.I am not a part of the warn act nor did i read all the posts. I did not see the need.I had assumed that you would indeed fill me in on the proceedings and you did not let me down.
i hate being lazy at times but at least i did delete my post that set you off.Sorry for that. I posted because i was involved w/a similiar but much smaller ordeal that did not have a happy ending.This particular albeit unfortunate deal has morphed immensely and that is a good thing.
I do commend you however for posting or having it posted,the names of the applicable law firm(s).That is an important piece of info.

 

How do you delete a post? and how do you send a message to a moderator? Who is the moderator?

 

hey BB.I am a bit hesitant to post on this thread but you asked a legit question that I actually read.GEt it? bad joke i know-
I deleted my post by clicking on edit(as if i was going to edit my post)and then merely erased or deleted all of the content of my post.
GRANTED,the only thing deleted is the content/body of the post,so one has to insert something like "I deleted my post" to compensate for the moniker still there and all that.
Can you tell that i am not computer literate enough to use proper terminology?

Hello everyone! I do agree about the lawyer thing. I saw one locally and he also agreed with what jodi242 said. The lawyers in New York are handling it and with their past experience, I feel ok about having them on board. We just wanted our own personal questions answered. Now...what the lawyer here said, if we wanted to fill out the form for the bankruptcy we could. But, we would not be considered unsecured creditors, but priority creditors. If we were to fill out that form that is how we would list ourselves. He did agree about the 401k money not being deposited as a NO NO! He asked if we had been sent anything from the Bankruptcy court and I told him no we had not. I may call Monday to the court and see if I cant talk to the person they have in charge called a trustie. Maybe he or she can tell me if we need to actually file it out or not. I know this still sounds a little like we are not sure what to do, but I hope to have more info after talking to the trustie monday if they will in fact talk to me.
