    All the cop has to do is ask for the phone, then go through the menu and pull up all calls. then the guy is nailed. if the guy does not comply, i am sure that "interfering with a police investigation" may take place, and the driver gets "hauled off" for a tiny bit. wanna chance this as well..??

    You're right about that. On my particular run, I do have my cb turned on, but it is nearly dead silent every night. But for the occasional conversations I do hear? At least I know it's working!!

    if bears do that, listen too be cb radios , then there dummer then i thought, think about it like nashville, Tn, it would drive a bears nuts as , why, becuse the interstate runs right along side the trucks stops there, you could be sitting inside the truckstop's and give out bear reports all day, and the time you get there, there long gone anyway, unless like what happen too me in pa, i needed too go bad , pull in rest area, o crap a full blown circuis going on , they were having a full blown dot inspection day , about 20 of them inspecting the rigs, i was told to park over there and wait, i told her i cant wait , i gotta go, she took that wroung, no no i gotta go in there, and i gotta a little smile out her, but i had everything in order, weight was good, i worked hard too make sure , that morning , everything pass, good too go she said, for me i dont worry about bears , much as i do 4 wheelers, every 4 wheelers think there a cop now, becuse they have a cell phone, o he just ran over a curb with his trl tadems, yes mam , we send a car right out :yes2557:

    All you have to say is no, and that is the end. There was a recent ruling allowing information from a phone, but it was AFTER the individual was arrested for another crime.

    Ok, you go with that, and tell the DOT cop..Oh and first, call me so I can listen in on, you getting beaten up.

    He won't get beaten up..but he probably get the ticket anyway, and a good butt chewin..LOL..however..your personal cell is your personal cell phone..if the company doesn't pay for it then they have to have a warrant to view its contents without your permission. Only things they can search are things that could contain drugs or alcohol that could be used by the driver or they can search the trailer..

    DOT has regs for us..also for their officers..all are public record..its best to bone up on both so you know what your rights are as a driver fully. There are things they are allowed to do and not allowed to do without a driver's permission or a warrant..interior searches of the cab for anything other than BOLs or Logs isn't allowed without the driver's permission..just like if the PD showed up at your house wanting to look around. If they suspect an illegal substance or open container and want to search your truck they can search the driver area only..not the sleeper. They got to have your permission to look beyond the seats, doors, dash, and floor/roof...Beyond that is personal property..if they insist..make them breathalize you first..if you at 0.0 then they really can't insist any more without a warrant. And if you on drugs then you shouldn't be driving period and they will UA or blood test you for that first before searching the inside of the truck.

    Yep I will go with that, and no I won't get beaten up. I will exercise my rights just like every citizen should do. Of course to exercise those rights, you have to know what they are first!!!

    Don't tell any of this information to the MN state police. I believe it was them that the OOIDA cracked down on because they were doing illegal searches, with VOLUNTEERS NO LESS of truckers rigs and writing tickets like no tomorrow.
