Miss a DOT Physical and you fail it?

    The level of testing done these days is very precise. False positives are very rare. False positives just don't happen these days, and if and when it ever did, you are certainly protected and entitled to prove it.

    If you will notice, the urine you provide is placed into two separate containers. Only one is initially used. The second is stored at the testing facility.

    All drug test results are reviewed and interpreted by a Physician, also known as a Medical Review Officer (MRO) before they are reported to the employer.

    If the lab reports a positive result to the MRO, he will contact you and request information to determine if there is an alternative medical reason for the positive result of an illegal substance. If you provide documentation and proof of a drug introduced into your system that triggered an improper finding, and the MRO determines that there is a legitimate medical use of the drug and that it was prescribed to you, the drug test result is reported as negative to the employer.

    If you are unable to resolve the positive result with the MRO, you have the right, within 72 hours to request the second specimen be sent to another Department Of Health and Human Services (DHHS) certifed lab for analysis.

    I'm sorry, but it would work, and it would be useless for you to do so. All challenges would have to include only samples of the original offered urine. That's the purpose of the second sample.

    I might be inclined to agree with you on your assessment when it comes to Attornies, but in this case, he or she would be right.

    If you can't clear it up through the testing of the original urine samples, you're stuck with the result, and there isn't a Judge that would see it otherwise. Too many have tried, and the testing procedures are that exact in the year 2006.
