MRO, reported script as positive, now what?

    I'm not sure about what you can do in the short term for employment on driving. Your situation is kind of unique since it's a school and a DOT drug test. You took the right step in retaining a attorney but it will not get corrected today or tomorrow, which I think your hoping for. It will probably take a month or two to get it straighten out. At least that's what my buddy is telling me. It's hard to tell if a school uses hireright and reports it. I know the MRO is suppose to report positives to the FMCSA database but I don't know if employers have access to this information. Now the problem you may find, if you do try getting a job during this time, when the employer verifies with the school of your credentials. They may have to report this to the prospect employer but don't hold me to that.

    Hey Rookie,

    Yeah this thing is going to take awhile. I dont want to keep apps flying out as I am sure each company keeps a reject list.

    As far as I can tell there is proposed legislation for DOT/FMCSA to implement a nation wide database to track all failed D&A screens. MRO would then be responsible for submitting these results within 5 days. As of now MRO's and Co's only report statistics from there D&A program. Companies can report to DAC but I think the regs only require them to take driver out of service and not to return until appropriate classes and evaluations are made. I do not believe they are reported on the Fed level, but some states require it to be reported if driver is liscensed out of said State.

    I believe I am close to accurate on these things, BUT I have read so much of the muumbo jumbo I have cotton balls in my ears to keep the mush from running out.

    Oh I think MIS data is what the MRO's report, no wait is it SIS, or OOPD, not sure. I do know it's not COPD.

    i did not read this entire thread so forgive me if anything i say has already been covered.
    i have tested positive for a prescription drug on a pre-employment once. the medical review officer calls you and asks for prescription information before sending in test results, you prove your prescribed the medication and a negative drug test is reported. seems how this what a test from the school rather than a employer it should not even go to dot, you don't need a drug screen to get a license only to get a job.

    In Texas MRO's are not required to report positive results to DPS Motor carrier division although they can. Employers are required to report all non negative results to DPS. There are a handfull of other states that require reporting to a State agency or trying to adopt a similar action. They are AR, CA, NC, OR, SC, WA.

    The good news the MRO did not report my results or has made the correction. I just spoke with DPS and my file is blank!
