The carrier agrees to cover any and all insurance related costs up to a fixed level, perhaps $250K or $500K before involving their insurance company in any claim.
Their primary liability company fills the gap between the self insuraence cap and the required amount to keep their authority active so the DOT is happy and that company MAY help the carrier with any claim adjustment as needed.
This is how the Mega carriers get to circumvent most insurance requirements to have schools and/or hire new CDL drivers with less experience than the insurance carrier desires by paying for all the minor(sic) stuff caused by so many inexperienced drivers.
So every time a mega bangs into something they dig in the piggy bank and pay to repair the damages and fix their own stuff with their own dime until the claim exceeds the self insurance cap and the primary insurance company steps in and even when the insurance is needed, the motor carier still has to cough up the $250K -or- whatever their cap may be.
It is not a captive insurance company, the program is validated by working with an insurance carrier plus the motor carrier must be liquid enough to pony up that $250K, claim after claim every time the stuff hits the fan.Bud A., kemosabi49 and CalculatedRisk Thank this. -
I think now with a CDL what ever you do is attached to your CDL forever.
Most places ask for a 5 year, cause the 5 year is a "certified" report. -
Your record can be purged after three years anyways. I’m not sure if that’s federal or a state-by-state basis.
