Name change

    Considering finally incorporating my business vs operating as a sole prop for 13 years. Was discussing this with a friend and he mentioned he heard brokers have put a hold on people with recent name changes or addrsss changes on safer. Anyone have experience with this? Anyone change there name lately and ran a broker load? Thank you

    It will be a red flag, and a change from sole proprietor to a corporation is an ownership change so you will have to redo your US DOT number and operating authority.

    With all yhe recent fraud it will be tough to prove you are still you with your broker accounts.

    I just did mine, basically just an 150 update, notify cargo insurance and change drug testing over, can’t help you in the brokered part though

    Why not use the name you have now? Just add LLC or Inc on the end of your current company name, depending on the type of corporation you use.
    That name change might flag you with brokers. Not as much as a complete name change.
    When I had a growth or tax reason to change to a corporation, I went to an LLC.

    Thank you for the replies everyone. I wasn’t aware that a change from sole proprietor to a Corporation is have to change my DOT and MC number. All I’d be doing is a name Change. I’m just operating under my name now. Been this way since 2013. Just trying to be more professional and separate the 2 better. Would that apply if I did my last name trucking inc/LLC as well? I’d have to change my MC and DOT? I definitely would not want to do that.

    Legally a corporation is a seperate entity from the owner, you. To change from sole proprietor, or even a single member LLC, is legally forming a new entity that will take ownership of your former business assets.

    Since a US DOT number belongs to one person, or entity, for life, a new corporation .Y need a new DOT number, depending on how your lawyer structures the operational changes.

    "We will allow a sole proprietor to maintain its USDOT number when it changes its current form of business, and the new entity will continue to operate virtually the same (absent the form of business change) as before the change. There would be no change in company officials, address, or other demographic information and the new entity will maintain identical operations, employees and assets. We will permit a change in the Tax ID number based on the new articles of incorporation."
