Not really no. That's a completely different issue.
You can be illegally parked and still be off duty in a cab because dusty status and parking are two different laws.

(4) All time in or on a commercial motor vehicle, other than:
(i) Time spent resting in or on a parked vehicle
So yes, unless you are otherwise on-duty, just being in the drivers seat does not mean you have to be on-duty.

Yeah i always showed off duty as soon as i stopped not matter if i was loading or offoading..Showed sleeper when i was..
