Alternatively, you could just quote Genesis 6:17 into the driving comments when the button turns red, then take a religious exemption.

@Ridgeline
What is the correct answer?
God bless every American and their families! God bless the U.S.A.!
The absolute sheer driving force of our national economy - without truck drivers, our entire national economy would come to an absolute standstill - if not outright be dead.

Over the mountains, through the woods, into the valleys, coast to coast, from sea to shining sea - truck drivers can and do go anywhere and everywhere, every day, every night, all year round. -
You stay in drive. Since you're on the road. It'd be different if you were pulled over.MidwestResident Thanks this.

Question 25: When a driver experiences a delay on an impassable highway, should the time he/she is delayed be entered on the record of duty status as driving time or on-duty (not driving)?
Guidance: Delays on impassable highways must be recorded as driving time because §395.2 defines “driving time” as all time spent at the driving controls of a Commercial Motor Vehicle CMV in operation.Wasted Thyme and MidwestResident Thank this. -
NO. At the very worst it would be ON-DUTY. If you are stuck in the middle of the highway with the truck turned off, you are NOT driving.
-
If I am stuck in a long traffic jam I will go lay down in the bunk. That to me is sleeper time until I get out of the sleeper. If truck cannot move for hours on end the hell if I am on the clock sitting in the driver seat for no reason. What happens if you are stuck in traffic for 20 hours and can't move?
-
Exactly. At the very worst, if you are sitting at the wheel and vigilant, then YES, you are on-duty (not driving). But if you are shut off and just relaxing, at minimum you can be off-duty. I remember being stuck with my trainer for about 3 hours somewhere in Illinois I think it was. Traffic was at a standstill. We just shut off the truck and went off-duty and that was that.
-
Except you are wrong. Look at the guidance of driving. You know the guidance that was posted twice already in this thread.
I don't agree with it, but I didn't make the regulations. Now that said, in the sleeper is another thing. you are no longer at the controls of a CMV. Heck, sitting in the passenger seat should be enough to go off duty. -
Well, that's what I mean. If I'm turned off in the middle of the highway, why the hell would I be in the driver's seat! It's either time for Netflix, Youtube or Kindle in the bunk! If you are in the seat, then I have already mentioned that it is on-duty, even if the truck is turned off. You can't be driving if you're not driving.Last edited: Apr 21, 2022
