NO. At the very worst it would be ON-DUTY. If you are stuck in the middle of the highway with the truck turned off, you are NOT driving.

 

If I am stuck in a long traffic jam I will go lay down in the bunk. That to me is sleeper time until I get out of the sleeper. If truck cannot move for hours on end the hell if I am on the clock sitting in the driver seat for no reason. What happens if you are stuck in traffic for 20 hours and can't move?

 

Exactly. At the very worst, if you are sitting at the wheel and vigilant, then YES, you are on-duty (not driving). But if you are shut off and just relaxing, at minimum you can be off-duty. I remember being stuck with my trainer for about 3 hours somewhere in Illinois I think it was. Traffic was at a standstill. We just shut off the truck and went off-duty and that was that.

I don't agree with it, but I didn't make the regulations. Now that said, in the sleeper is another thing. you are no longer at the controls of a CMV. Heck, sitting in the passenger seat should be enough to go off duty.

 

Well, that's what I mean. If I'm turned off in the middle of the highway, why the hell would I be in the driver's seat! It's either time for Netflix, Youtube or Kindle in the bunk! If you are in the seat, then I have already mentioned that it is on-duty, even if the truck is turned off. You can't be driving if you're not driving.
