the issue lies with 2 different sets of rules in the us--one from ins and one from ice,i beleive
the one set of rules will allow the one incidental move if it is in direction of canada--while the other rules wont allow it
now if you pick up in a free trade zone in laredo or at a port--you can haul it anyplace in us
i have an article on this--i will try and find--it was written cause of us carriers running cabbotage in eastern canada--at us rates

That's not the way I read the example. To me it looks like it would be legal because he is immediately picking up a load to be exported back to Canada.
The example clearly states... Canada to US destination... US to US destination... then US to Canadian destination.
So why wouldn't his example be legal? -

Hitherto, I had always thought it was illegal for a foreign vehicle to engage in domestic traffic, in either country. Where does your quote (#4) come from?
The vehicle can operate from point to point, the vehicle part is allowed by US Customs. It's the DRIVER that has to have clearance from Immigration & Naturalization Service to conduct the operation point to point.
Customs and Immigrtation are totally different from one another. -
They cannot pick up a US load and deliver it anywhere in the US. They can pick up a US load and take it to Canada. -
read the part about conflicts between customs and ins--that is where the problem comes in
myself i would consider it cabotage to run a us to us load--or canadian to candian load
now i might be a bit biased since i can do that--but i dont want to many other to be able to have the luxury -
us customs will allow an loaded incidental move--but ins doesnt allow it
and customs rules state that ins rules must be followed
so therefore you cant run a loaded trailer point to point in us,unless you pick it up at a designated free trade zone -
