They should let the offender be tested for amounts , if its trace ok maybe . High amounts, tester can know this guy has been chiefen . I think they could discern with a blood test especially if the cbd is high and thc is vry low . Just a thought .

After all Thomas Jefferson did say something along the lines , '' the highlight of the day was smoking HEMP on his veranda.''.

There is no oversight whatsoever on the makers/marketers of CBD products. So a lot of their products get out with more than the allowable 0.3% THC. The FMCSA has even issued warnings about this.
So it doesn't matter if you smoked a doob or ate some CBD gummies, if you have THC in your system, you will fail a UA.

Best scenario is this: He takes a blood test, and it is clear. He may have to pay for this himself, and maybe even arrange it himself just to show that he is serious. With a clean test, you company will be watching you like a hawk, so expect 'random tests' like every other week for the next year or so. And, whatever you do, don't touch any of the substances I mentioned before, EVER, especially anything with THC, regardless of the local legality. As a professional driver, you may NEVER use any of them. I

f these guys want to play hardball, you're going to have to beat them at this game. If they don't want to let you re-test, then your next call is your department of labor, then maybe an attorney. Fight hard, man. Get back in touch and let us know what happens.

And, I probably don't need to tell you this, but if you fail a second test, well, you're screwed. Sorry.

If i recall blood tests aren't accurate because THC is stored in fat and slowly dissolves over time.
Regardless as others have adequately pointed out its a ZERO tolerance industry!
You're going to want to find a high risk trucking industry/mega mega that carries expensive insurance because of accidents and even then the law of driver supply & demand will probably bite you in the keister! I wish you luck!

Go apply at dump truck companies. I don’t know how well pot heads get along with meth addicts but what the heck give it a shot

The reality is that most companies follow the regulation that a drug or alcohol event disqualifies a driver from operating a CMV for a minimum 3 years. This came from my company. Even if the SAP, which can circumvent that, most companies don't want to deal with that. They aren't willing to fork over the cash or the time when dozens of clean drivers are available. Then you lack experience so that's a double whammy. It's a real chance that you'll have to wait a minimum 3 years to get back in the truck. I'm not saying that you can't find a driving job, it'll just be tough. Drivers have had success going to work in food service and hauling beverages, but the number of drivers who have had success doing that does not exceed those who haven't. I had experience when I flunked a UA, and it took me 8 years to get back to running with a reputable company. I hauled beverages in Nashville, then I went the 1099 route for some years. You can try Craigslist, and try foodservice or beverage companies, but don't get your hopes too high because you'll need a lot of luck on your side. Be prepared to wait 3 to 5 years to get another shot at it. Good luck brother

The one recreational pot smoker we had at my last company, the owner and his son abused him BECAUSE of his record. I'm talking 100+ hour weeks doing forced runs others said no to because of excessive hours or conditions. He ended up crashing again (2 trucks in 3 years totaled) and his cdl was suspended. Didn't help he had a speeding 12-18 over, operating left of center and inattentive driving before falling asleep at the wheel. The end result was the same, now he works in the cheese factory for 40k a year instead of delivering to it for over 100k a year.

Dump/cement trucking gets desperate this time of year! Watch out for AG exempt companies. Milk, Grain and Cattle Haulers and such. If they make you keep logs it's probably a good thing....

So your question about how to get back on the road is the same answer as any bad record issue (tickets, DWI, drugs, ect). Your best shot will be trying to get on with a “2nd chance” company. Bad pay, safety score, ahole dispatchers. So your best chance will be like Western Express.
