Need advice!

    Well the d bag thing to do is say it never happened. No cops, no video, no proof. It cant affect your cdl. Insurance says pay up, you say take me to court or sese and disist. Sound to me the insurance paid for it, and now are trying to mitigate their loss's. Happens all the time. Badger someone, threatening law suits yada yada, you get back to them, the say the bill is 4 grand, but they will let it go for 3....

    I'm still trying to figure out how an 06 freightliner falls into gear that easily with the engine running, and how a truck moving at a whopping 1/2 a mile an hour can force another truck forward hard enough to damage a bumper if that truck had the brakes set.

    I realize every truck and trans shifts different, but I know I can't even get my tractor into LOW with the clutch out and brakes released, I have a hard time believing any part of this. I suppose truth is stranger than fiction but a lot of this just doesn't make any sense.

    And on that not, what the hell caused what we shall call truck 2 in this post to be pushed into truck 3. after being hit by truck 1 at idle speed with no driver. at idle in first when truck 1 contacted truck 2 at idle speed with the clutch out given truck 2 had the brakes set and properly adjusted truck 1 should have simply died.

    Do none of the trucks in this yard have their brake set?
    Let em take you to court. Let a judge decide percentages of liability. I would be willing to bet it may be something like 90 them 10 you.

    Thanks for the advise. I think I will let them take me to court if they wish to pursue this. And get a good lawyer.

    I'd say that's your best bet it just isn't adding up in my mind. I'd run long and far from a truck like that. That's just my .02

    Why wait to react for court proceedings with hiring attorney. Proactive, hire attorney now and they might not even think of sueing.

    I have tried. I have spoken to several lawyers and they all told me that unless I get sued they cannot help me.

    Driver you damaged the mans truck and now your trying to weasel out.Thats bad carma dude.Maybe you need to stay away from equipment if you don't know what your doing.Tear up someone's property and try to blame the invisible man.

    The man? Have you read the whole post? I said I do not mind paying for some but not all. The insurance company has paid for the repairs, they have been made whole. It's the insurance company that is out of something at this point. And we both know they get paid every month regardless if you use it or not. and if you do file a claim they can and most likely will raise your rates. When was the last time you had any type of accident of any sort (i.e drop/break anything not just car accident)? Did you ever think that maybe I am that particular company's bad karma from all the years of them getting over on their drivers?
