Need dot consultant? Dot advice

    Hello ! Can you give me advice on my situatioin? Can they give me a 'random BAT test' when you are OFF-DUTY ?
    And, if my log shows I'm off-duty, can a company say that checking on a load, using the in-cab terminal put me 'ON DUTY'?
    In driving school, I was told that a driver's log is an official federal document. IF IT SAYS YOU ARE DUTY, YOU ARE OFF DUTY.
    Dot regs. also states that no company can give you a random Alcohol Breath Test when you're off duty. THEY CAN GIVE YOU A RANDOM DRUG TEST! NOT A RANDOM ACLOHOL BAT TEST!!!!

    Am I right, or wrong on this?
    Also, can they include this info. on a job reference if the test was improper ??

    Where were you when they requested the Breath alcohol test? Where you at your house? The truck? I think we need more information. How did the scenario start?

    Hello all.
    Just a quick, and I hope, easy question.
    Does the time spent getting a biannual DOT physical need to be logged on line 4?
    I know the random drug test does, but I can't find in the regs anything about whether or not I need to log the physical.

    I was dead-headed back to the terminal. After safety inspection, I was told by 'dispatch' that there were no loads for the day, or the entire week end. So, I turned in my logs/trip sheets at 1600. I took my self 'off duty' from 1600 thru midnight. Called my friends to pick me up and go play golf. After golf, we had a couple of pitchers of beer. At 2100 hours, I asked my friends to take me back to the yard, so I could pick up my bus/camper. At the gate I was told that there may be load fo TN. I told them that there was a TN driver, waiting to go home. I went to tell dispatch about this; there was no one there. Across the hallway was, safety, and I asked about the load - that's when they pulled me in for BAT test. 2130 hours.

    I want to mount a personal vehicle behind my sleeper. The vehicle is 106 inches wide. Considering the 102 inch width limit for the truck and that the personal vehicle will be more than legally secured, are there any problems with this?

    wouldn't have even went on the property with any measurable alcohol in my system

    You cant exceed 102 in many jurisdictions without a permit.

    I would have stayed off the property personally. I don't know what your company policies are, but they may prohibit being on the premises.

    If you are on their property and inside talking to someone about a load, then you are definately under the guise of the available for drug and alcohol testing.
