Need dot consultant? Dot advice

    My cousin drove for about a year and a half and for a beginner driver he really picked up trucking and did a very good job. He was definitely a natural. He also like to occasionally drink beer. I believe he was at his terminal one night waiting for truck repairs and decided to indulge in a few beers. Probably not the smartest choice but he's done worse. He got a surprise dot breathalyzer first thing 6am by one of the companies employees. I don't know how random it was but that's irrelevant. He failed the test and was let go. The company actually really liked him and paid for him to get home. My question is how does this affect his driving future? He was not issued a citation. He was not driving at the time. Will this go on DAC? I know it maybe hard to get company job but what about as an O/O? Technically it wasn't a DUI and he was never adjudicated of anything. Please help if you have any info on the matter. Thanks everyone.

    He needs to get a copy of his DAC report its free get the information online, not all companys report to DAC but if it was one of the big companies England Swift ect. you can bet that its on there sorry for the bad news good luck.

    Since we was selected for a random alcohol test and tested positive, he now is disqualified from any safety-sensitive functions. He MUST see a substance abuse professional (SAP). The company is only required to provide you with a number to a substance abuse professional / or clinic, this substance abuse professional must be familiar with 49 CFR Parts 40 and 382. Below i have provided you with that information. Once you pay the fee to see the SAP, he or she will evaluate you and recommend alcohol misuse training, i.e. counseling sessions, abuse videos, etc, however, the SAP and the person whom conducts the training can not be the same person, as this is a conflict of interest. Upon completing all the required training, the SAP will send a memo to the motor carrier with the required about of drug and or alcohol tests to complete the training. Upon completing the alcohol misuse training, and the SAP sends the letter to the motor carrier, stating all training is complete, than and only than can you start the return to duty process. Upon testing negative on the return to duty test you may return to work if the carrier wants to re-hire.

    nationwide provider of Substance Abuse Professional (SAP) services and will provide you with a list of
    names, addresses and phone numbers of local, qualified Substance Abuse Professionals.

    You may become eligible to obtain safety-sensitive employment or perform safety-sensitive duties
    only after you have met the following conditions:

    [FONT=&quot]1. [/FONT]A Substance Abuse Professional (SAP), as defined by DOT Drug and Alcohol Testing
    Regulation, 49 CFR Part 40, must evaluate you. You must actively seek. enroll in. and
    complete the assistance that is recommended by your SAP.
    You must then meet with your
    SAP and participate in a follow-up evaluation wherein the SAP will determine whether or
    not you have complied with all recommendations
    . If you are found to be in full compliance,
    the SAP will make recommendations for your return to duty. This wil
    l include a follow-up
    drug and/or alcohol-testing plan that must be followed.

    [FONT=&quot]2. [/FONT]Once return-to-work eligibility is established, you must also provide a negative sample on a
    return-to-duty test (for drugs and/or alcohol)
    .
    Per DOT Regulation, your SAP's recommendations prevail and can be changed only by that SAP.
    DOT Regulations do not a
    llow for a second SAP opinion. Should you disagree with your SAPs
    recommendations and decide to obtain an evaluation from a different SAP, the original SAP is
    authorized to report that you did not comply with the original recommendation(s).

    Until all requirements are met, you will not be eligible to perform DOT safety-sensitive duties for any
    employer
    . Violators are subject to substantial fines and penalties if found to be operating in a safety-
    sensitive capacity without having first completed a DOT qualified SAP program.

    My boss has a Dodge duelly that is her personal truck. We have used it to pull a mobile restroom trailer for the business. I know I still have to go through weigh stations but am I supposed to have usdot numbers on that truck? What are the rules for personal vehicles and usdot requirements?

    Sounds to me like it is being used for the business. If the combination GVRW is over 10,000 lbs you meet the criteria to come into the guidelines.

    Is it legal for employer to dispatch a load he knows you don't have the hours to run? Chapter & verse please...

    Legal, yes. It's illegal for him to even try to force you to run it, but it's also hard to prove that he ever did.
