ok one last question, one of my newly hired driver has ez pass from his last employer that he still uses because he had money in it so i have no tolls from him will that be an issue

 

He should be able to produce the records if needed. I don't think it becomes your problem until you reimburse him for those tolls and need the receipts for your records. If you aren't paying for them, it's on him same as anything else he decides to buy for himself.

 

You may want to check, but I believe ez-pass devices are registered to a pacific vehicle.

I have a question if I may.
Am I legally required to show 15 minutes on line 4 of my log at the end of each day for a post trip inspection?

You are required to show all time performing inspections as line 4 (on-duty not driving) time. There is nothing saying how long you have to take or show in your log. You log what you do. That's it.

If it takes less than 15 minutes, then follow the interpretation in 395.8.

 

I have a question.

For the most part, I am 100 mile/12 exempt, not required to keep a log book. But every once and a while I get sent out of state for a single delivery with no back haul. I keep a log book for those runs, but I don't when I am exempt.

I know that one has to record days off or vacation in the log book. Do I have to do something like that when I am 100 mile / 12 hour Exempt.?

 

I've never logged a Post trip Inspection. I only log 15 minutes on line 4 ( Paper Logs ) for a Pre-trip inspection... The only time I have gotten a violation for this is from Illinois on a road side inspection when I was pulled over... I was pulled over for a random inspection and the trooper said that I have to log a post trip but not a pre trip... I've had two log book inspections this year ( Washington and South Dakota ) and have logged it like I have since day 1 of my driving career, which is only 15 minutes for the Pre-trip and no post trip and neither state gave me a violation. The safety department at my company says that I am doing it right by logging the 15 minute PRE trip and nothing at the end of the day....

(1) Report required.Every motor carrier shall require its drivers to report, and every driver shall prepare a report in writing at the completion of each day's work on each vehicle operated, except for intermodal equipment tendered by an intermodal equipment provider. The report shall cover at least the following parts and accessories:

 

Which states ONLY that a report must be filed at the at the end of each day FOR EVERY VEHICLE OPERATED.

If the law required an inspection to be performed AT THAT TIME, the driver would have to locate all vehicles operated that day and perform an inspection on them at the end of his shift.
