Need help with payroll

    I have been currently working for a brand new owner operator. When I got into discussing payroll with him, he said he doesn't know how to do it and he said he will just write me a check every week. I've been logging the paychecks down and leaving money in the bank for taxes, but I'm kinda worried that he may be breaking some laws by not doing a payroll of some sort. Does anyone have any information on this?

    Is he taking out taxes? Do you get a paystub showing that? If not you will be getting to know the IRS some time in the future.

    Ask if you are covered by workers comp, bet not.

    The law requires an employer to provide with each pay check a breakdown of the wages and the deductions for the check.

    I would tend to think that you are being paid by 1099 and not as an employee.

    Ask for a breakdown of the wages and etc because the bank requires it or something.

    Contact the state unemployment office with the name of the company.

    He told me he has workman's comp for me. I'm also looking up payroll laws and there is information all over the internet about getting employer identification numbers, reporting to the irs and state. To tell you the truth, I think I should quit this owner operator in a heartbeat. Are there any owner operators out there that know what their doing with payroll?

    oh by the way, he's writing personal checks to pay me. He's not doing any 1099 or anything. One week he gave me cash.

    If he is writing personal checks or giving you cash, you are being paid by the owner through methods that will result in 1099.


    Just so you know, I am an accountant also, and do taxes as well. I do payroll and such for some clients, but I retired from full time accounting because it was driving me nuts.

    I'm a O/O who knows how to do payroll. I don't have any employee's and don't want any. I will answer questions......
