Never Convicted...but have been arrested

    the charges were dropped without prejudice at my prelim hearing because the person admitted that they lied about the situation to the judge

    it's up to you man, but being dismissed without prejudice means they can re-file the charges, so it is going to be on your background check or it might not if they don't do a thorough one. It really depends how extensive they get on it. It's your call, but personally i would tell them.. if it costs me the job, then at least I know I'm not stuck somewhere and I can always find other employment.. OR you can look at it as they didn't ask, so you didn't bring it up, although that will not save your job if they find it and do care about it. Although they may not care about it anyhow. As said before, there are alot of variables here.

    lol no not like an oj simpson kind of deal, it never even went to trial, it was dropped at the preliminary hearing 2 years ago

    I would not worry about it then. If you are really concerned about it being brought up then contact security and ask. It most likely is not on your record.

    it will be on his record somewhere, but probably not on the background checks that trucking companies do. If he were looking for security clearance or something, it would show up. I wouldn't worry too much about a trucking background in this situation.

    People are arrested for things they did not do all the time.
    If they are convicted they are guilty.
    If they win, or charges are dropped for good, then they are presumed innocent, since they have not been proven guilty.
    That is the law. That is our rights.
    So I do not believe that any background check should be able to hold something against you that you did not do.
    That is like OJ in a way. Sure he was arrested. I would almost even bet that he did it.
    But since he was not proven guilty beyond the shadow of a doubt, his record is clean on that charge.

    I agree with everything you're saying.. I have my degree and I think the judicial/criminal system is about the most messed up system in the world at some points. This is exactly why I'm going to drive truck instead of becoming a cop or something, can't stand the politics. The last thing I'm trying to do is argue with you here, but he didn't go to jury trial to get the charges dropped, if he did then it would be off his record. They were dropped at the pre-trial WITH prejudice, which means they COULD bring those charges back if more evidence arises. Had they been dropped WITHOUT prejudice, it would not have been on his record either. I'm not an attorney or anything, so I don't know if that would show up on a standard background check or not, but it will be on there somewhere (maybe only for law enforcement to see, i'm not sure). Thanks for the response ChromeDome.. i like a good debate (not argument, debate) it gets me thinking and I like that hehe :):biggrin_25522:

    I could have sworn that he said it was dropped without predjudice. Otherwise I never would have argued it lol. Now I have to look back......
