    You are completely correct. However, this idiocy has a cause. A few days ago I made a comment about how the FMCSA bungled the rollout of CSA. I can't remember the year they decided to change the system in use before CSA, however, at least once a month before it became effective I was getting an email from my company with large fonts warning me about CSA 2010. Add to this now is truck stop myths. This is getting so bad I was asked a while back how many CSA points will a driver get if their elogs show a violation. Safety critters across almost every area in trucking do this as well. Today this crap has a momentum that looks to be unstoppable. This is why I made my comment about 383.51. New drivers get so worked up over CSA that they lose sight of the whole picture. CSA, DAC, PSP is acronyms I am starting to wince when I see used in these forums. Drivers need to start thinking about MVR, 391.23 and 383.51 a whole heck of a lot more.

    The trooper just came along to assign blame, fill his quota, and generate revenue. No wrongs were made right.

    Chinatown is absolutely right. Exchanging insurance information was sufficient, and no security guard can legally detain you.

    Chinatown's deft maneuvering advice was also quite relevant. :thumbup:

    there shouldn’t be a citation if it didn’t happen on a public roadway, no hit and run, and the drivers resolved it themselves. a police report stating that officers responded - at most.

    That depends on state law. I don't know about Florida but about 20 years ago I got a written Texas warning at a rest area in my POV. I asked the Trooper that gave it to me about that he said that entire area was considered an extension of the Interstate exit and entrance ramps.

    Part 395 states a Truck Driver MUST take a 10 hour break. I report a conversation I had with a COP. I report that as a fact, am I now a truck stop/forum lawyer?

    Apology accepted but not needed. I knew you were not speaking directly to me. The comment I quoted, however, might be right in some places. I can't tell you how many times I have told somebody their comments were BS only later to discover I was the one wrong. So many in fact that unless I know for an indisputable fact I will start looking before I say anything.

    Not to defend someone else but I live down in Orlando and I know exactly how full those rest areas can get due to lack of adequate truck parking. It also never ceases to amaze me the amount of drivers that constantly park like ######## because of their lack of planning. When I pick my spot I will intentionally park where I know I can easily get out because I know someone is going to crawl in with 1 minute left of their drive time and block someone in. Just take your time and when in doubt it's better to get out and look or wake someone up than hit them

    I'd fight that ticket. I've been perusing the job boards lately and many carriers wont hire with a careless or wreck less in the past 5 years...food for thought.
