new driver need help

    Hello this is my first time posting on here and im not sure if im in the right spot but i am having a problem. i was hulling a flatbed load from lindin new jersy of steal pips on i 80, some one cut me off and slammed on their breaks. i had to come to a hard stop and my load shifted and caused some damage to the headboard and tarp of my conestoga. my company had me sign papers for them and put me on probation, but now there aggressive telling me that they need a written statement of what happened signed by me and they are telling me they are going to keep my paycheck untill i give it to them i wouldn't normally have a problem with this but a driver friend of mine told me not to because they could sue me for the damage of the trailer. and after seeing how they handled the payment of the company in new jersey that had to re stack my load im sure this is some thing they would do( they didn't want to pay him and were trying to get me to leave) so i need to know is this some thing normal for me to have to do. can they sue m. are they able to keep my paycheck they did take out 1000 from my check when i started for a escro that was suppose to handle the deductible of the insurance in case of this but now there trying to keep my paycheck what should i do?

    just give em the statement, junebug. if you had it secured properly it wouldn't have shifted, ya screwed up, own up to it. and why shouldn't you pay for it??? you did it , not them

    Employees have a lot of rights compared to contracted truckers.

    QUIT them right now and call the labor board. They are bad news, not wanting to pay the guys who fixed the load.

    And please out them here!

    There is so missing information, are you a OO or a company driver. It sounds like you did not have the load secured properly. It also sounds like either you were not paying attention or you were following too close or traveling to fast for the conditions.

    An escrow account indicates you are a lease operator, which is not to be confused with a owner op., if this is true its on you. If your a company driver there liable for everything you do unless they can get you to agree to pay, do not agree.

    Tis true. Load Shift=Improper Load Securement. Sorry.

    How much was the insurance deductible? If you had insurance, any damage to the headboard of the trailer should be covered. Did you call and make a claim? Pictures?

    Federal law says if it is not your fault, you do not have to pay for it. That's why companies have insurance.
