Newbie needing Help!!!

    Hey guys

    I am a newbie driver i was in training with my compnay back in april when i sufered an on the job eye injury. I have now fully recovered and have 20/20 vision. I was returned to full work status by my doc on 9/2/08 the medical dept called and verified some info said they'd call back 9/3/08. Thats the last i've from them... oh yeah i did get the company xmas card last week. Does anyone have any advice?

    You'll have to be more explicit in what took place.
    1.Were you considered employed at the time of the injury?
    2.Were you covered under workmans compensation?
    3.Did the injury happen from your negligence?
    4.How serious was the injury and if it wasn't why did it take so long to be cleared to return to duty?
    5.Have you kept all records from insurance,company and doctors from day one to present?
    6.In your companies manual does it state what reasons are grounds for termination or refusal to hire?

    Yes i was considered employed and i was covered under workmans comp. The injury was not due to negligence it was a freak accident. It was pretty serious a piece of metal damaged the lens in my eye and it had to be replaced, hense th length of time off. I have all m records.

    All right, lets try to understand somethings.I'll keep it simple but I've been through the system.Your a liability.Fair?No.By using workmans compensation you increased the companys costs.Workmans comp is mandated by the state through a private insurance carrier.Any time a worker is injured on the job the companys rates go up.Under the law you may seek further compensation even after you return to work.Future liability towards the company may occur.The company also lost close to six months productivity and profit from you while you were out.If you feel you have been wrongfully terminated,contact your states labor board and insurance commissioner.If that fails, hire a lawyer versed in comp and labor law.I did ask you about your companys handbook on termination but I doubt that it will hold up in court in your case.I miss the days when trucking was not so complicated.I am not a lawyer nor a doctor but if you need anymore guidance I'll see what I can do to help.

    Have you called your employer and asked them what's going on? If not, don't wait for their workmans comp. dept to call you they'll let you sit forever, they could be waiting to see what your going to do. I'd call your DM and let them know your ready to go back to work.

    The other issue might be that many companies are not hiring on new drivers due to the current economic situation and general lack of freight.

    This is very true. Some companies are freezing hiring drivers especially inexperienced ones. Also their lawyers could be just waiting to see what you are going to do. If your really hard up for a job you can apply for a company with a high turnover rate like cr england or someone like that.

    They told you that they would call you back the next day, and now, 3 months later you are asking what you should do? If it were me, I would be calling them every day wanting to know what is up. Are you still receiving a weekly check from worker's comp? I would be concerned that maybe your clearance to return to work got mixed up somewhere and worker's comp would require repayment.
