No line 5 for personal use on elogs

    Try as you might, you won't find mention of "personal conveyance" in the regulations. Rather, it's based on some DOT guidance that was first published in 1975. Here is that guidance in its current form, relating to 49 CFR §395.8:

    I'm not gonna post the guidance, because I'm tired and lazy.

    I have posted the exact FMCSR and the guidance that goes with it several times. I'd hunt it down again, but my allergies are kicking my butt and I have a headache.

    The long and short of it is this: The vehicle must be unladen. It may be used in transit for personal reasons between a point of rest (truck stop or motel) and a place to eat...and back. It may be used to transport one's self to and from the terminal. Etc....

    Some cops try to say you can only use it for personal reasons if it is bobtail. This is true when you are in transit. You must be unladen. Therefore, if you want to go to Hooters from the truck stop under personal use and you are under a load, you must drop the trailer. However. If your trailer is not loaded and you can find a Hooters with truck parking, you can go under personal use.

    I'm with you, it would make me feel better if they defined their terms. Leaving stuff open to interpretation takes black and white and makes it gray.

    Adding too, my last carrier didn't allow line 5 for co. drivers and o/o's must be unhooked from the tank.

    My current lease allows personal conveyance however safety has cautioned not to be hooked to a trailer to alleviate any suspicion. Also 20 miles is the recommended max travel.........again, suspicion if stopped. Kinda, what are you really doing????

    I like the idea of having to send for approval to use line 5. now I just need to find someone that works nights and weekends that I can trust.

    On second thought, maybe we'll leave that alone.
