O/O Load claim insurance denied coverage

    I wanted to know what to do about a load claim that has been denied by my insurance. My insurance says the load is not damaged and if it were it is not covered by my policy if it was improperly packaged or stored. . I agree the load is not damaged and was not sure why customer would not accept load. It rained that day but load was tarped . The water from tires and road did wet cardboard around wood and a few boxes with plastic tubing but wood was not wet or damaged. Customer took some of the wood but not all. Question is how do I handle this now that insurance will not pay and broker is not trying to pay my factoring company for previous loads and trying to collect on this claim. Broker is trying to get customer to take wood and sell what he can customer will not respond. The wood is flooring and then there is plastic tubing. This is my first claim I’m pretty new as o/o. They also want me to try and salvage the load. Is worth about $10k.

    The more knowledgeable on this subject will reply soon. Until then, stay in contact with the broker, make sure to get the name of everyone that you speak with. Take pictures of the load as it sits, as well as the product.

    Protect product from further damage.

    Contact your state trucking association or OOIDA, for further assistance. You may need to get legal guidance with this.

    Since you are new and they don't want to pay you for the previous loads, I assume the broker is TQL, is that right?

    Not covered by your insurance then try to sell what you can to off set the claim. A claim has to have an exact amount, not just around some amount. Part 370 will give you the guidelines.

    Or you can do what a lot of single O/O's do if the claim is more than what you are owed. Walk away and ignore it.

    Exactly plastic tubing in which the boxes got wet.
