If you didn't have time to change lanes or stop...that's called "too fast for conditions" period. It's that simple

real easy to armchair quarterback after the fact.

I hit a deer that jumped in my lane from behind an bridge embankment. Didn't see it either. Admittedly not the same as hitting another vehicle but things do happen.

If you come around a curve in a pitchblack night, or over the crest of the hill, he may truly not have had the time to react.

And than God it's not up to you to be the judge in this case.

If there are dips in the road preventing the road ahead from being visible, especially at night, I slow down, no excuses. I'm not gonna go 35, but if the limit is 70, and I cant judge whats past the next curve, dip, or hill, I'm doin 55. If you cant see, SLOW DOWN.

You were in the bunk, so all you can do is take his word for it. I'm sure he is a safe driver, but everyone here knows, just because he had plenty of hours left on his log book dont mean a #### thing.

I've been the road you speak of, I've had "close calls" there, and countless other roads. Notice, "close calls", not near misses. Near misses are what people who don't pay enough attention get into. I recognized a situation, I couldn't see far enough ahead because of dips in the road, so I dropped to 55, and rendered it a non issue. Not an interstate hwy in america has a grade steep enough to hide a container truck until the last second. When you top a hill, there's no way you're gonna miss it if you are paying attention.

Stop talking! You are winning the stupid, parked driver's case!

Ask to have this thread deleted since you are talking about a case that is in litigation! Do you realize that all the attorneys have to do is search for "crash" and the road name and with little to no work this thread will appear?

I also am pretty sure that even deleted pages are cached (stored).

Ask for help with getting a paycheck, but stop talking about the case!

should at least lock the post as it is in litigation.

It's already cached in enough places to still be found unless they want to go to every server and delete them.

I had a deer standing in the road. I slowed down to pass him and he darted in front of me at the last second. Took out a headlight assy. I called dispatch to let them know. They actually asked if I went back to check on the deer. I told them after 9 tires rolling over it, I doubt the deer was moving anywhere any time soon.

    No, it's NOT that simple!:biggrin_25513:
With all the experience you have driving a rig as a student driver, listening to class room scenarios, it would be better to keep listening or reading rather than telling someone what they should be or not be doing.
Don't care how you sent it either!

I really hope things work out for your husband and you Cyneca. I'll be praying for both of you.
