    Someone told me that if you do get in an accident, and let's say this same scenario had happened 3 months ago, and they do an investigation and look back and see an HOS violation, that you would go to jail regardless if it was your fault or not. How true is that?

    Why would you go to jail? And what difference would it make from now or three months ago? An accident is an accident unless you were egregiously violating the laws. Getting to a "safe haven", which doesn't really exist, isn't an egregious violation of HOS. If you were speeding, drunk and texting, then yeah, you'd probably go to jail, if you killed someone.

    One of my buddies that I went to trucking school with said that in his orientation, one of their safety guys told him something along the lines of:

    If someone writes a note stating that they are going to get in their car and commit suicide by pulling out in front of the first tractor trailer they see and you kill him and it's clearly not your fault, that you will still go to jail and be blamed for it if they find an HOS violation within the past 6 months.

    I thought it sounded a little extreme but I don't know, it almost sounds plausible, I'm sure a lawyer would love to try and blame the driver and the company to get some extra money for a client.
