Out of hours while on detention

You should finish getting loaded or unloaded. Once finished unloading you either sleep there or you drive to the NEAREST safe place to park and note it in your logs that you were proceeding to park after being detained at a customer.
Make sure you get with a company safety person and let them know what is happening and why. The new FMCSR guidance is that you can proceed to the NEAREST(read: even if that means advancing the load, even if that means you go in the wrong direction!) safe place to legally park. If you’re asking this question, I assume you probably work for a mega carrier. Your rest period will begin when you are safely parked, not necessarily when you’re logged off duty or sleeper at the shipper or final.
And for future reference... in two years, I have not logged a single second as anything but sleeper berth when being loaded or unloaded for this very reason. At Swift it was never questioned in a log audit and I still got thousands in detention pay. At my current company they tell you in orientation that the minute you hit their gate, you’re off duty sleeper. There simply isn't enough information in that OP's first or next post about anything. -
I ran out of my 14 in traffic on the way to the pilot around oak creek Wisconsin yesterday
I burned up my 14 which also ate my 5 hours I had left on my drive clock while waiting in the sleeper berth to get unloaded.
Took off down the road to go to Oak Creek from Wapanau which is hour and 20 minutes away with 2 hours left on my clock.
Traffic came to a halt 6 miles from my destination.
While stopped I switched to personal conveyance added comment stuck in traffic seeking parking and than drove on it for 30 minutes for 7 miles.
What do you think the DOT will think about that? -
Communicate this to the people running the docks. See if they will allow you to take your 10 there. If not I would suggest you just stay where you are until you are finished then leave and get to the closest legal place to park. Make sure you notate in your elogs what happened. There is no easy answers here. This sucks, but drivers have had to deal with this for years.x1Heavy Thanks this.

you can just creep around till you are unloaded and use Off-duty Driving (personal use) for one hour to somewhere to park
