His statement that he was off duty should be prima facie evidence that he is. The officer cannot force him to go on duty to retrieve his log book for inspection.

you dont know your rights as a driver, you should

once you show him your log book, you have given him evidence to cite you
just like you dont show a cop your garbage, receipts, not even BOL (after you dropped your load)
you dont give him more than 8 days, because if he finds something on the 9th day, he can cite you
you dont give him permission to search your truck under ANY circumstances, not even at border crossings
when they pull you over and ask you, do you know why i stopped you? you ALWAYS say,no i do not
you dont have to pull over on the shoulder, you have the ability to continue to a safe place if they hit you with the lights

Really? I've been driving 6 months, 60,000 miles mostly in the northeast, and been pulled over exactly -0- times. Bobtail or with trailer.

I did have a cop come up next to me at a traffic light in NJ to let me know that my rear trailer door had popped open once. :biggrin_25513:

dino, you should always have your stuff together

log book current, med card, etc

however, the issue here is "does the driver have to hand the cop his logbook if he is off-duty?" and according to what i have been told by any and everyone, the answer is NO

now, that doesnt mean the cop wont be ticked off or whatever, but thats not the issue
