out service violation

    He didn't touch his log book for 7 days hmmmm. Ok class this is not rocket science. He has over 12 years experience. I'm sure he know's better. Just because you tell the Dot officer you haven't done nothing in 7 days don't mean anything. Show me the PAPER baby :)

    The mistake he made (and we all make... me too) is he WENT TO WALMART to buy cheap products from China.

    Why were you out of service. You weren't on duty to make money so technically you don't need to log. You went to the store for food. You don't need to log that at all because you we're using it as a personal vehicle at this time for conveyance.

    He Got in trouble because his log book was not up to date. Not because of the personal conveyance. Gee's

    § 395.8Driver's record of duty status.(a) Except for a private motor carrier of passengers (nonbusiness), every motor carrier shall require every driver used by the motor carrier to record his/her duty status for each 24 hour period using the methods prescribed in either paragraph (a)(1) or (2) of this section.(1) Every driver who operates a commercial motor vehicle shall record his/her duty status, in duplicate, for each 24-hour period. The duty status time shall be recorded on a specified grid, as shown in paragraph (g) of this section. The grid and the requirements of paragraph (d) of this section may be combined with any company forms. The previously approved format of the Daily Log, Form MCS-59 or the Multi-day Log, MCS-139 and 139A, which meets the requirements of this section, may continue to be used.

    dino, when i go off-duty for long periods of time, i dont touch my logbook till i get back onduty,

    so if i left nyc to boston, and arrived in boston, after my delivery, i go to the nearest truckstop, i dont touch the logbook till i leave

    because if i am going back on duty on 11/22 and i stopped earlier on 11/20, i put 11/22 on the date and put two days offduty

    Ahhhhhhh he should not have been put out of service. He was relieved of duty when he delivered his last load. He was not attached to a trailer and was not under dispatch. He is allowed to use the truck for personal use. He also does not have to log anything for the previous days as he can do it on one log,once he goes back on duty. I use to to use my truck all the time and never had an issue as long as it was for my personal use.
