the applicable regulation posted in that link relates to agriculture.
i hope this thread gets burried and fast. before companies get wind of this.
i could see a whole lotta hourlies walking away.
that overtime pay in summer construction is what paid the bills for the winter. -
the trucking industry falls in the category of interstate commerce. they are not liable to any state entity as far as payroll claims are concerned. any wage claims/complaints have to go through the US dept wage and hour division. all they are legally required to pay you is minimum wage for the amount of hours it would have taken you to drive said distance. and it will be straight pay no matter the total of hours.
that is the fact. pure and simple. i have a thread on here about a former company jerking me around about my final paycheck. i eventually got the check, but i found out that if i pressed hard enough. i was gonna screw myself for several hundreds of dollars. so i had to wait until they wanted to pay me. its a dirty way to operate, but it is totally legal. i spent 3 days on the phone over that and the law is clear. -
I get overtime after 40 but companies are not required too.If you want to pay me by the hour then your going to pay me overtime or I'm walking otherwise pay me by the load.

Time and a half after 8. Anything on Saturday or Sunday.

I drive for Central Transport and we get overtime but starts at 55 hours not 40

the law states 40. but apparently there are exemptions. that would seem to favor just about every industry.
so basically the law is just a joke. -

A local company here does'nt pat any OT.The drivers pretty much max their hours every week.They use to pay overtime but stopped that when the economy went sour.
