A company can put pretty much anything they want on a drivers DAC. DAC is completely arbitrary, with no real rules or controls. That's why so many people consider it to be such a crummy program. There are many companies who don't report to or use DAC reports at all, and companies who report every silly little thing they can think or make up. DAC is baloney all the way around, no matter what's on it.

As far as I understood to be officially declared OOS driver or vehicle should has violation that meets OOS criteria, right?
Overweight violation doesn't meet that criteria according to official CVSA manual. So I don't quite understand what is the reason cop put OOS in his inspection report for my truck? -
He probably doesnt know either. I got stopped in mi and weighed on portables. He claimed l was over on three axles and 4500 over gross. Ran me out of hours while he worked me over. Let me leave after my 10 hours were up. He held my license because i didn't have enough cash on the spot. I went to the magistrate the next morning and paid up to get my license back. I asked him how i was supposed to move 2 45000 lbs coils there. He just laughed and asked me if i was going to fix the load? I got it and said yes sir. He was like don't worry he won't pull you over a second time in a shift. Can't guarantee another dot wont though Lol It was fixed when i unloaded it at the customer the next day. Just a money grab never seen anything on my cvor about it after that either.

It is probably a miswording. You cannot run overweight without a permit. They will not issue a permit because it is a divisible load. Hence they can prevent you from further travel until the weight issue is fixed. They may have called it an out of service but it is not.

1. A company CAN NOT just stick something up on DAC/HIRERIGHT, this is a myth. DAC has a set way that data is recorded. A company can't just say we fired the guy because he was an #######. DAC is a database with a set format. Try to place something out of format about a person DAC will kick it out. Anybody that has a DAC report knows how data is recorded. DAC is used by thousands of companies in and out of the logistical transportation industry. Yes there has been legit complaints lodged against DAC. DAC has paid out thousands of dollars in fines and judgements because of it and have tried to put safeguards in place. Another myth that keeps getting spread is small carriers don't use DAC. Drivers DAC is here to stay. It is part of being a driver. If you follow the rules have no accidents or positive drug tests you have nothing to fear about DAC. I have a copy of my DAC file, there is nothing on it that is inaccurate. In this same thread there is questions about CSA. A carrier I don't care if it has 3 trucks or 3 thousand has to be careful who it hires. Let a carrier hire a CSA (problem driver) and this driver kills someone not only is the carrier going to pay out money this carrier will also have CSA issues. DAC fills a purpose to let a carrier know about a driver as a part of the pre hire process.
One thing I have learned over the 6 years I have been a part of TTR is most of the time when a driver comes in these boards with their tales of woe is we don't get all the facts. Some small point is left out. So of course people are going to do their best to discredit systems like DAC. DAC is about driver accountability so anything that brings sense and accountability are called stupid obsolete or just wrong. Honestly I would believe a DAC report on a driver even over his mother because generally it is going to be a correct snapshot of that driver. -
