We are talking about between 4 and 16,000 over gross with 1/2 tank or less of fuel when loaded in 48' spread axle trailer...10' spread. It goes against driver and then co correct with CSA2010?

Overweights stay on your record if YOU sign the citation, unless you carry and OWNERS RESPONSIBILTY form with you which in that case the citation will be mailed to the owner.

Actually...the CSA will only be points on your CSA score board...and points for the company as well....what wasn't mentioned the points against your CDL through the DMV and don't forget the county/state court....they get their piece of the pie right out of YOUR pocket...not the companies!

In the last several years before I "retired", I got an overweight ticket about every trip that I went out on. I got so many overweight tickets at a certain set of scales that the people that worked that scale and me got on first name basis. And not one "black mark" or points on my dmv or CSA, the company paid the fine and to this day, my dmv and my CSA are "clean".
